ORDINANCE NO. 956
AN ORDINANCE AMENDING EAGLE CITY CODE, TITLE 8 "ZONING", CHAPTER 8 "AREA OF CITY IMPACT", TO MODIFY THE EAGLE AREA OF IMPACT BOUNDARY IN ACCORDANCE WITH IDAHO CODE 67-6526; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City of Eagle, Idaho is a municipal corporation organized and operating under the laws of the State of Idaho; and
WHEREAS, on December 17, 2008, the Ada County Board of County Commissioners adopted Ordinance 718 which was the most recent county-approved impact area for the City of Eagle;
WHEREAS, on September 15, 2025, the Eagle Planning and Zoning Commission held a public hearing in accordance with Idaho Code 67-6509 and Eagle City Code Section 8-7-8, and made a recommendation to the Mayor and Council to modify the Eagle Area of Impact Boundary;
WHEREAS, on October 14, 2025, the Eagle City Council held a public hearing in accordance with Idaho Code 67-6509 and Eagle City Code Section 8-7-8, to modify the Eagle Area of Impact Boundary as shown on the attached map (Exhibit "A");
NOW, THEREFORE, BE IT ORDAINED, by the Mayor and City Council of the City of Eagle, Idaho as follows:
Section 1:        That Eagle City Code Chapter 8, be, and the same hereby is, amended to read as follows with underline text to be added and strike-through text to be deleted:

8-8-1: EAGLE AREA OF CITY IMPACT BOUNDARY:
  A.   The Eagle area of city impact is the area designated on the Eagle area of city impact boundary map dated July 8, 2004 September 10, 2025, incorporated herein by reference and as may be amended from time to time, copies of which are available at the Eagle city hall and the Ada County development services department.
  B.   In case a property under single ownership is divided by the boundary line of the Eagle area of city impact, if such line divides such property so that one or both of the parts has a depth of three hundred feet (300') or less, such part may be included in the jurisdiction within which the remainder and larger portion of the property is located.
  C.   The city shall not annex the land designated in ordinance 275.
8-8-2: ANNEXATION TO OCCUR ONLY IN AREA OF CITY IMPACT:
8-8-3: APPLICABLE PLAN POLICIES AND ORDINANCES:
  A.   The Eagle comprehensive plan, as adopted and amended by the city on September 14, 2004 November 14, 2017, by resolution 04-15 17-24, shall apply within the Eagle area of city impact,. adopted on June 22, 2004, by ordinance 475 and as may be amended from time to time. Subsequent amendments to the aforesaid Eagle comprehensive plan shall apply within the Eagle area of city impact if the city and the county so agree.
  B.   The Ada County comprehensive plan, as adopted by Ada County on June 17, 1996, by resolution 882, and hereby amended, shall apply within that part of the amended Eagle area of city impact identified in ordinance 475 separate from the Eagle area of impact identified in ordinance 461.
  CB.   Applications for subdivision development in the Eagle area of city impact shall be evaluated for conformance to the design and improvement standards contained in title 9, chapter 3, and sections 9-4-1 through 9-4-1-12 of this code.
  DC.   All subdivision plats situated within the area of city impact shall be submitted to the city for their recommendation.
  ED.   The Ada County zoning ordinance shall be used to implement this chapter.
  F.   The following additional standards shall be used to ensure compatibility between the Eagle comprehensive plan and the Ada County zoning ordinance:
     1.   "Density" shall be defined as the ratio of the total number of dwelling units within a development divided by the total area. Fractional densities which are greater than the density shown on the corresponding comprehensive plan land use map designation will not be allowed. Floodway areas and lands used for public uses such as schools and public service facilities shall be excluded from the total land area used for calculating residential densities.
E.  Applications for conditional use permits, master site plans, master site plan modifications, private streets, parcel divisions/one time divisions, expansions or extensions of nonconforming uses, planned unit developments, subdivisions, and rezones within the Eagle area of impact shall occur as a result of a request for annexation to the city of Eagle; however, Ada County may consider such applications in those exceptions where annexation is not approved by the city of Eagle or where the parcel on which such application is filed is not contiguous to the city of Eagle, and therefore cannot be annexed.
8-8-4: AMENDMENT OF PLAN POLICIES AND ORDINANCES:
  A.   All applications to Ada County (the "county") or to the city for amendments to their respective comprehensive plans and implementing ordinances which apply within the Eagle area of city impact shall be sent by the entity receiving such application to the other entity. A separate referral process shall be adopted by resolution by each entity, regarding procedures and time period for, and the effect of, sending such amendments, and such resolution may be amended from time to time upon mutual agreement in writing by the county and the city.
 
B.   All county applications for planned developments, subdivisions, rezones and conditional use permits within the Eagle area of city impact shall be sent to the city of Eagle, in accordance with the referral process established pursuant to subsection A of this section.
8-8-5: ZONING WITHIN THE EAGLE CITY AREA OF CITY IMPACT:
  A.   County zoning districts shall be in accordance with the adopted plan policies identified in section 8-8-3 of this chapter.
8-8-6: RENEGOTIATION OF PLAN POLICIES AND CHAPTER APPLICATION PROVISIONS:
  A.   In accordance with Idaho Code section 67-6526(d), the city of Eagle or the board of Ada County commissioners may request, in writing, the renegotiation of any provision of this chapter at any time. Within thirty (30) days of receipt of such written request by either party, a meeting between the two (2) jurisdictions shall occur.
  B.   While renegotiation is occurring, all provisions of this chapter shall remain in effect until this chapter is amended or a substitute ordinance is adopted by the city of Eagle and Ada County, in accordance with the notice and hearing procedures provided in title 67, chapter 65 of Idaho Code, or until a declaratory judgment from the district court is final. Provided, however, that this chapter or stipulated portions thereof shall be of no further force and effect if both jurisdictions so agree by mutually adopted resolution.
Section 2: The provisions of this ordinance are hereby declared to be severable and if any provision of this act or the application of such provision to any person or circumstance is declared invalid for any reason, such declaration shall not affect the validity of remaining portions of this ordinance.
Section 3: That this ordinance, or a summary thereof in compliance with Section 50-901A, Idaho Code, shall be published once in the official newspaper of the City, and shall take effect immediately upon its passage, approval, and publication.
