Resolution Declaring Intent to Abandon and Close a Portion of Hagers Road WHEREAS, the Town of Huntersville (the "Town") has filed a petition to close a portion of Hagers Road, in the Town of Huntersville, as further described in Exhibit A – Legal Descriptions; and WHEREAS, N.C.G.S. §160A-299 allows for municipality to permanently close any street or public alley; and WHEREAS, N.C.G.S. §160A-299 requires that the Board of Commissioners for the Town of Huntersville (the "Board") first adopt a resolution declaring its intent to close the street and calling a public hearing on the question; said statute further requires that the resolution shall be published once a week for four successive weeks prior to the hearing, and a copy thereof be sent by registered or certified mail to all owners of property adjoining the street as shown on the county tax records, and a notice of the closing and public hearing shall be prominently posted in at least two places along said street or public alley; and WHEREAS, the Board desires to, pursuant to N.C.G.S. §160A-299, declare its intent to close a portion of Hagers Road, as further described in Exhibit A. NOW THEREFORE, BE IT RESOLVED BY THE TOWN OF HUNTERSVILLE BOARD OF COMMISSIONERS (the "Town Board") AS FOLLOWS: The Town Board resolves that it intends to close a portion of Hagers Road, as further described in Exhibit A. The Town Board hereby calls a public hearing on the question of closing a portion of Hagers Road to be held at 6:00pm on Tuesday, the 18th day of November, 2025, at Town Hall, 101 Huntersville-Concord Rd, Huntersville, NC, 28078, or location as otherwise designated by the Board. The Clerk of the Board is hereby directed to publish a copy of this Resolution once a week for four successive weeks prior to the public hearing. This Resolution shall be effective as of the date its adoption. Adopted this 21st day of October 2025. EXHIBIT A – LEGAL DESCRIPTIONS Being a remaining portion of the 60' Hagers Road right of way, bounded by the new Hagers Road right of way as recorded in Map Book 73, Page 855, McCord Road variable right of way, Parcel ID 011-013-72 & 011-191-06 in the Town of Huntersville, Mecklenburg County, North Carolina, and more particularly described as follows: Commencing at #4 rebar found, having grid coordinates N:618,518.35 ft; E: 1,452,722.34 ft, and also being the Southeastern corner of William M Haigler, and Jerri P Haigler as recorded in Deed Book 36662, Page 711, and Map Book 56, Page 800: thence S 87°01'27" W a distance of 121.84 feet to a found #4 rebar on the former Hagers Road right of way, and the Point of Beginning; thence 87°01'27" W a distance of 20.82 feet to a #4 rebar set along the new Hagers Road right of way; thence with the new road right of way with a curve to the left having a radius of 461.00 feet, a length of 39.04 feet with a chord bearing N 13°20'32" W a distance of 39.02 feet to a computed point; thence N 15°00'02" E a distance of 13.41 feet to a computed point; thence N 72°50'00" E with a distance of 2.50 feet to a computed point; thence with a curve to the left having a radius of 470.50 feet having a length of 43.68 feet with a chord bearing of N 19°49'34" W a distance of 43.66 feet to a computed point to the Southern corner Parcel ID 011-013-72 of William M Haigler, and Jerri P Haigler as recorded in Deed Book 39543, Page792, and also being the Western right of way of Hagers Road; thence N 15°37'12" E with a distance of 63.38 to a computed point on the McCord Road variable right of way; thence with right of way N 63°35'15" E a distance of 76.49 feet a computed point on the Northwestern corner of William M Haigler, and Jerri P Haigler as recorded in Deed Book 36662, Page 711, and the Eastern right of way of Hagers Road, thence with said right of way S 14°04'39" W a distance of 192.50 feet to The Point of Beginning, having an area of 8,382 square feet, more or less, as shown on Exhibit B prepared by Professional Property Surveyors, dated 8/05/2025.
