ORDINANCE NO. 957 AN ORDINANCE OF THE CITY OF EAGLE, ADA COUNTY, IDAHO, AMENDING TITLE 6, "PUBLIC WAYS AND PROPERTY", CHAPTER 5 "WATER SYSTEM", SECTION 5 "APPLICATION FOR SERVICE", PROVIDING FOR CODIFICATION; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Eagle, Idaho, is a municipal corporation organized and operating under the laws of the State of Idaho; and WHEREAS, the City of Eagle, Idaho, desires to change the method of refunding water customer deposits; and NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF EAGLE, Ada County, Idaho; Section 1: That Title 6, Chapter 5, Section 5 "Application for Service" be and is hereby amended, in part, to read as follows with underline text to be added and strike-through text to be deleted: 6-5-5: APPLICATION FOR INITIATION OF SERVICE: A. Application FormInitiation of Service: To initiate water service shall sign anapplication form provided the applicant shall contact the at city hall giving the date of application, and provide the location of premises to be served, the date applicant desires services to begin, purpose for which services are to be used, the address for mailing of the billings, the class and the size of the meter service and such other information as the water department may reasonably require. In signing the application, With the request to initiate service the applicant agrees to abide by the rules and regulations of the water department. The application is merely a written request for service and does not bind the water department to provide service. B. Deposits And Establishment Of Credit: At the time application for service is made, the applicant shall establish credit with the water departmentat city hall. Deposits shall be held for one year from the date of deposit. A deposit will be included in the customer's first water bill for the establishment of water service. The deposit will be noted on the customer's account. The City will not pay interest on any deposits. 1. Deposit Requirements And Establishment Of Credit: With each andevery application for water service to be supplied through the water system of the city, there may be a deposit required by the city clerk, or its designee, a sum in cash, the amount to be determined by resolution of the city council upon the uponthe passage of this chapter and reviewed at least annually and updated by resolution of the council. 2. Deposits: a) Application of Deposit: Deposits will be applied to the account after the City has received twelve (12) consecutive on-time payments. At the time the deposit is given to the city clerk, or its designee, the applicant will be given a receipt for the same. The deposit isnot to be considered as a payment on account. b) Discontinuation of Service: In the event the service is discontinued, the deposit will be applied to the closing bill and any amount in excess of the closing bill will be refunded to the account holder. The city will not pay interest onany deposits. Deposits shall not be eligible for refund until after one year of service indicating a satisfactory payment history. Section 2: If any part of this ordinance shall be held unconstitutional or void, such part shall be deemed separable, and its invalidity shall not affect the remaining parts of the ordinance. Section 3: The City Clerk is instructed to immediately forward this ordinance to the codifier of the official municipal code for proper revision of the code. Section 4: This ordinance, or a summary thereof in compliance with Idaho Code §50-901A, shall be published once in the official newspaper of the City, and shall be in full force and take effect immediately upon its passage, approval, and publication.
