Ordinance NO. ORD-33-25 BY THE COUNCIL CORLESS, HALLYBURTON, MORALES, NASH, STEAD AND WILLITS. AN ORDINANCE (CAR25-00004) FOR PROPERTY LOCATED AT 2626 AND 2680 S MAPLE GROVE ROAD AMENDING ZONING CLASSIFICATIONS OF THE CITY OF BOISE CITY TO CHANGE THE CLASSIFICATION OF REAL PROPERTY PARTICULARLY DESCRIBED IN SECTION 1 OF THIS ORDINANCE AND ADJACENT RIGHTS OF WAY FROM R-1A (RESIDENTIAL: LARGE LOT) TO R-1C (RESIDENTIAL: TRADITIONAL); SETTING FORTH A REASONED STATEMENT IN SUPPORT OF SUCH ZONE CHANGE; AND PROVIDING AN EFFECTIVE DATE. NOW THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF BOISE CITY, IDAHO: Section 1. That the land use zoning classification of the following described lands within the city of Boise City, Idaho, as set forth in Exhibits A (Legal Description) and B (Map) are amended and reclassified from R-1A (Residential: Large Lot) to R-1C (Residential: Traditional), pursuant to the procedures and requirements of Idaho Code Title 67, Chapter 65 and Boise City Code Title 11, Chapter 5, and the Boise City Comprehensive Plan, as a result of changed circumstances and to promote the public health, safety, and welfare. Section 2. The lands described in Section 1 hereof are subject to the Airport Influence Area Sensitive Lands Overlay District and the standards in Boise City Code Title 11, Chapter 2, Section 7 as modified from time to time by Boise City ordinance. Section 3. Pursuant to Idaho Code § 67-6535, the Boise City Council hereby adopts the following Reasoned Statement: Reasoned Statement The rezone from R-1A (Residential: Large Lot) to R-1C (Residential: Traditional) is consistent with the approval criteria of Boise City Code (BCC) Section 11-05-05-4.I (Zoning Map Amendment). There has been an increase in Boise's population which has been detailed with the Housing Needs Analysis Report from 2021. The rezone from R-1A to R-1C will allow for a higher density development where service and infrastructure exist to support the proposed density. This infrastructure includes utilities, roadways, public transit with a bus stop within walking distance, improved bike lane, schools, and a public park. The residential infill project is supported in this location and is in the best interests of the public convenience since it will utilize existing infrastructure, and it supports alternative modes of transportation. The site is located along Maple Grove Road which contains bus route number 28 with a bus stop located 200 feet to the south of the subject property. The development will provide a safe route to a public school with a pathway connection to the adjacent school site. The proposal is compatible with the surrounding area in terms of size, scale, height, and density. The development will be comprised of one and two story detached single family homes which are similar to the residential neighborhoods located to the north and west across Maple Grove Road. The comprehensive plan promotes compact, walkable developments that support transit and discourage development patterns that rely solely on vehicles for transportation (Policy ES 1.4). The subject property is adjacent to Maple Grove Road which contains a public transit bus route with a bus stop within walking distance. As such, the proposed R-1C zoning designation is not in conflict with the comprehensive plan as outlined in Goal SW-CCN 1, Policies PDP 1.1, and ES1.4, CC 1.1(a), and Principle GDP-C.1. Section 4. The zoning maps of the city of Boise City, Idaho, are hereby changed, altered, and amended to include and insert the real property described in Exhibits A and B hereof in the land use classification therein described. Section 5. That this Ordinance shall be in full force and effect from and after its passage, approval, and publication. ADOPTED by the Council of Boise City, Idaho, on October 14, 2025.
