Notice is hereby given that Coastal Gunite Construction Company has filed a Complaint pursuant to 46 U.S.C. §§ 30501 et seq. claiming the right of exoneration from or limitation of liability for all claims arising out of the operation of the dive support barge boat Delaminator and an
unnamed pontoon-type dive platform, on the waters of the Croatan Sound between Manns Harbor and Roanoke Island in Dare County, North Carolina, incidental to the death of Justin Wade McNealy on June 25, 2024.
All persons having claims must file them as provided in Rule F of the
Supplemental Rules for Certain
Admiralty and Maritimes Claims,
Federal Rules of Civil Procedure, with the Clerk of this Court, at the United States Courthouse at Wilmington, North Carolina, and serve on or mail to Coastal Gunite Construction
Company's counsel, Clark, Newton & Evans, P.A., attention: Seth Buskirk, 509 Princess Street, Wilmington, North Carolina 28401, a copy thereof on or before the 12th day of December, 2025, or be defaulted. Personal
attendance is not required.
Any claimant desiring to contest Coastal Gunite Construction
Company's allegations must file an Answer to the Complaint as required by Rule F(5) of the Supplemental Rules for Certain Admiralty and
Maritime Claims, Federal Rules of
Civil Procedure, and serve on or mail to counsel for Coastal Gunite
Construction Company a copy
thereof.
