BEING THE SAME PROPERTY CONVEYED TO ROBERT FERRARA AND GERALDINE FERRARA, AS JOINT TENANTS WITH RIGHT OF SURVIVORSHIP, BY DEED OF FRANCES B. RAUS, TRUSTEE OF THE FRANCES B. RAUS TRUST AGREEMENT DTD. 05/04/2007, DATED NOVEMBER 28, 2017 AND RECORDED DECEMBER 4, 2017, IN BOOK 3626 AT PAGE 2192, IN THE OFFICE OF THE REGISTER OF DEEDS FOR BEAUFORT COUNTY, SOUTH CAROLINA. SUBSEQUENTLY, GERALDINE FERRARA PASSED AWAY, THEREBY VESTING FULL LEGAL TITLE IN THE SURVIVING JOINT TENANT, ROBERT FERRARA. SUBSEQUENTLY, ROBERT FERRARA PASSED AWAY, LEAVING THE SUBJECT PROPERTY TO THEIR HEIRS OR DEVISEES. TMS No.: R600 041 000 0229 0000 Property Address: 46 POINTE SOUTH TRACE BLUFFTON, SC 29910 TERMS OF SALE: The successful bidder, other than the Plaintiff, will deposit with the Special Referee, at conclusion of the bidding, five percent (5%) of his bid, in cash or equivalent, as evidence of good faith, same to be applied to the purchase price in case of compliance, but in the case of non-compliance to be forfeited and first applied to the cost incurred by the Plaintiff related to the sale and the balance then applied to the Plaintiff's debt in the manner suitable to the Plaintiff. Should the last and highest bidder fail to comply with the other terms of the bid within thirty (30) days, then the Special Referee may re-sell the property on the same terms and conditions on some subsequent Sales Day. A personal or deficiency judgment being waived by Plaintiff, the sale shall close on the day of the Sale Purchaser to pay for documentary stamps on the deed. The successful bidder will be required to pay interest on the amount of the balance of the bid from the date of sale to the date of compliance with the bid at the rate of 6.00% per annum. The sale shall be subject to any past due or accruing property taxes, assessments, existing easements and restrictions of record and any other senior encumbrances. The sale shall be subject to all title matters of record and any interested party should consider performing an independent title examination of the subject property as no warranty is given. Neither the Plaintiff no its counsel make representations as to the integrity of the title or the fair market value of the property offered for sale. Prior to bidding, you may wish to review the current state law or seek the advice of any attorney licensed in South Carolina. In the event an agent of the Plaintiff does not appear at the time of sale.
