NOTICE OF SALE NOTICE OF SALE CIVIL ACTION NO. 2024-CP-46-03058 BY VIRTUE of the decree heretofore granted in the case of: Freedom Mortgage Corporation vs. Thomas J. Wells, III; Carmen L. Wells; Jefferson Capital Systems, LLC; Midland Funding LLC; LVNV Funding LLC; The United States of America, acting by and through its Agency, The Secretary of Housing and Urban Development, the undersigned Master In Equity for York County, South Carolina, will sell on November 3, 2025 at 11:00 AM, or on another date, thereafter as approved by the Court, at the Master in Equity's Office, 1675 York Highway, Courtroom C, City of York, State of South Carolina, 29745, to the highest bidder: Situated in the County of York, State of South Carolina. Lot 104, on final plat of Amber Woods, Map 1, prepared by Fisher-Sherer, Inc., dated May 20, 2000, and recorded October 5, 2000, in the Office of the Clerk of Court for York County in Plat Book B-275, at Page 6. Also being shown as Lot 104 of Amber Woods Subdivision, on a plat of property of Tom Wells prepared by Hucks and Associates, PC, dated December 24, 2003, and recorded in the Office of the Clerk of Court for York County in Plat Book C242 Page 2. This being the same property conveyed to Thomas J. Wells and Carmen L. Wells by deed of The Ryland Group, Inc., dated December 29, 2003, and recorded December 30, 2003, in Book 5959 at Page 259 in the Office of the Clerk of Court for York County, South Carolina. Thereafter, Thomas J. Wells and Carmen L. Wells conveyed the subject property to Thomas J. Wells, III, and Carmen L. Wells, as joint tenants with right of survivorship, by deed dated January 16, 2014, and recorded February 3, 2014, in Book 13952 at Page 256 in said Records. CURRENT ADDRESS OF PROPERTY: 104 Amber Woods Dr, Tega Cay, SC 29708 TMS: 643-14-01-002 TERMS OF SALE: The successful bidder, other than the Plaintiff, will deposit with the Master In Equity, at conclusion of the bidding, five percent (5%) of his bid, in cash or equivalent, as evidence of good faith, same to be applied to the purchase price in case of compliance, but in the case of non-compliance to be forfeited and first applied to the costs incurred by the Plaintiff related to the sale and the balance then applied to the Plaintiff's debt in a manner suitable to the Plaintiff. Should the last and highest bidder fail to comply with the other terms of the bid within twenty (20) days, then the Master In Equity may re-sell the property on the same terms and conditions on some subsequent Sales Day. No personal or deficiency judgment being demanded, the bidding shall not remain open after the date of sale and shall be final on that date, and compliance with the bid may be made immediately. Purchaser to pay for documentary stamps on the Deed. The sale shall be subject to taxes and assessments, existing easements and restrictions, easements and restrictions of record and any other senior encumbrances. The Defendant United States of America (non-IRS) waived in writing any federal right of redemption under 28 U.S.C. § 2410(c).
