NOTICE OF SALE NOTICE OF SALE CIVIL ACTION NO. 2025-CP-46-00897 BY VIRTUE of the decree heretofore granted in the case of: Freedom Mortgage Corporation vs. Jose Davila; Gina Davila; Richard A. Parrillo; Rawlinson Road Homeowners' Association, Inc., the undersigned Master In Equity for York County, South Carolina, will sell on November 3, 2025 at 11:00 AM, or on another date, thereafter as approved by the Court, at the Moss Justice Center, 1675 York Highway, Courtroom C, City of York, State of South Carolina, to the highest bidder: All that certain piece, parcel, or tract of land lying and being situate in York County, South Carolina, and being known as Lot 4, Phase I, of Rawlinson Acres II, as shown on plat of Rawlinson Acres II, Phase I, dated July 9, 1986, and recorded August 8, 1986, in the Office of the Clerk of Court for York County, South Carolina in Plat Book 83, Page 87, and being further shown on plat entitled "Plat of Property of William W. Beaver and Sherrie A. Beaver" dated May 5, 1995, prepared by White Land Surveying and recorded in Plat Book 130, Page 26, and having such metes and bounds, courses and distances as reference to said plat will more fully appear. This being property conveyed to Jose Davila and Gina Davila, as joint tenants with right of survivorship, by Deed of Richard O. Gregory, II and Olivia M. Gregory dated August 30, 2023 and recorded October 4, 2023 in Book 20980 at Page 496 in the Office of the Register of Deeds for York County, South Carolina. CURRENT ADDRESS OF PROPERTY: 1120 Eagle Drive, Rock Hill, SC 29732 TMS: 540-05-01-013 TERMS OF SALE: The successful bidder, other than the Plaintiff, will deposit with the Master In Equity, at conclusion of the bidding, five percent (5%) of his bid, in cash or equivalent, as evidence of good faith, same to be applied to the purchase price in case of compliance, but in the case of non-compliance to be forfeited and first applied to the costs incurred by the Plaintiff related to the sale and the balance then applied to the Plaintiff's debt in a manner suitable to the Plaintiff. Should the last and highest bidder fail to comply with the other terms of the bid within twenty (20) days, then the Master In Equity may re-sell the property on the same terms and conditions on some subsequent Sales Day. No personal or deficiency judgment being demanded, the bidding shall not remain open after the date of sale and shall be final on that date, and compliance with the bid may be made immediately. Purchaser to pay for documentary stamps on the Deed. The sale shall be subject to taxes and assessments, existing easements and restrictions, easements and restrictions of record and any other senior encumbrances.
