NOTICE OF SUBSTITUTED TRUSTEE'S SALE
WHEREAS, on 01/23/2007, ALVIN MAYS executed a promissory note payable to the order of SOUTHSTAR FUNDING, LLC, as Lender.
WHEREAS, the aforesaid promissory note was secured by a Deed of Trust dated 01/23/2007, executed by ALVIN MAYS AND KENISHA MAYS, HUSBAND AND WIFE and being recorded on 02/08/2007 in Instrument No. 2007 1326 T-J2 of the records of the Harrison County, State of Mississippi; and which aforesaid Instrument conveys to KIRK SMITH, Trustee and to SOUTHSTAR FUNDING, LLC, as Lender, Mortgage Electronic Registration Systems, INC., as Beneficiary, the hereinafter described property; and
WHEREAS, MORTGAGE ELECTRONIC REGISTRATION SYSTEMS, INC. ("MERS"), SOLELY AS NOMINEE FOR SOUTHSTAR FUNDING, LLC, assigned said Deed of Trust to U.S. Bank Trust Company, National Association, as trustee, as successor-in-interest to U.S. Bank National Association, as Trustee, successor in interest to Bank of America National Association, as Trustee, successor by merger to LaSalle Bank National Association, as Trustee for Residential Asset Securities Corporation, Home Equity Mortgage Asset-Backed Pass-Through Certificates, Series 2007-KS4 via an instrument filed of record on February 19, 2018 and in Instrument No. 2018-456-T-J2 in the office of the Clerk of the Harrison County, State of Mississippi; and
WHEREAS, U.S. Bank Trust Company, National Association, as trustee, as successor-in-interest to U.S. Bank National Association, as Trustee, successor in interest to Bank of America National Association, as Trustee, successor by merger to LaSalle Bank National Association, as Trustee for Residential Asset Securities Corporation, Home Equity Mortgage Asset-Backed Pass-Through Certificates, Series 2007-KS4 appointed Western Progressive - Mississippi, Inc., as Substitute Trustee in the place of the aforementioned original Trustee via an instrument dated 08/12/2025 and record on 08/14/2025 in Instrument No. 2025-0005623-T-J2 of the records of the Harrison County, State of Mississippi and
WHEREAS, default having occurred under the terms and conditions of said promissory note and Deed of Trust and the holder having declared the entire balance due and payable; and
WHEREAS, Western Progressive - Mississippi, Inc., the Substituted Trustee in said Deed of Trust will on 11/05/2025, between the hours of 01:00 p.m. and 4:00 p.m., offer for sale and will sell at public outcry to the highest bidder for cash At South Front Door, Harrison County Courthouse (2nd Judicial District), 730 Dr. Martin Luther King Jr. Boulevard, Biloxi, MS 39530, the following described property located and situated in Harrison County, Mississippi, to wit:
LOT 155, HOLLY HILLS SUBDIVISION, PART III, A SUBDIVISION LOCATED IN THE SECOND JUDICIAL DISTRICT OF HARRISON COUNTY, MISSISSIPPI AS PER MAP OR PLAT THEREOF ON FILE IN PLAT BOOK 6, PAGE 23 IN THE OFFICE OF THE CHANCERY CLERK OF HARRISON COUNTY, MISSISSIPPI.
More commonly known as: 774 SHARON HILLS DRIVE, BILOXI, MS 39532
Subject to the rights of way and easement for public roads and public utilities, and to any prior conveyance or reservation of mineral of every kind and character, including but not limited to oil, gas, sand, and gravel in or under subject property.
As the undersigned Substituted Trustee, Western Progressive - Mississippi, Inc, will convey only such title as is vested in it under said Deed of Trust.
