STATE OF FLORIDA DEPARTMENT OF ENVIRONMENTAL PROTECTION NOTICE OF PROPOSED AGENCY ACTION The Florida Department of Environmental Protection (FDEP) gives notice that it proposes to approve a No Further Action Proposal with Institutional Controls and issue a Site Rehabilitation Completion Order with controls for a contaminated site. Terreno 73rd Street, LLC is seeking this order in reference to FDEP site ID #8515170, Terreno 73rd Street LLC, 3022 NW 73rd Street in Miami, Florida 33417 and intends to restrict exposure to contamination in the following manner: by recording a Restrictive Covenant running with the property deed preventing the use or extraction of groundwater without regulatory approval. Complete copies of the No Further Action Proposal, the Restrictive Covenant are available for public inspection during normal business hours 8:00 am to 4:30 pm, Monday through Friday, except legal holidays at the Miami Dade County Department of Regulatory and Economic Resources on behalf of the FDEP at 701 NW 1st Court, 4th Floor, Miami, Florida 33186 and online at the FDEP document database OCULUS https://depedms.dep.state.fl.us/Oculus/servlet/login using the above facility ID number. Local Governments with jurisdictions over the property subject to the institutional control, real property owner(s) of any property subject to the institutional control and residents of any property subject to the institutional control have 30 days from the publication of this notice to provide comments to the FDEP.
