Notice of Sale C/A No: 2025-CP-36-00388 BY VIRTUE OF A DECREE of the Court of Common Pleas for Newberry County, South Carolina, heretofore issued in the case of Guild Mortgage Company LLC vs. Uriel Pacheco-Contreras; Toula Economos Hubbard I the undersigned as Special Referee for Newberry County, will sell on November 3, 2025 at 11:00 AM at Newberry County Court House, Newberry, South Carolina 29108 to the highest bidder: Legal Description and Property Address: ALL THAT piece, parcel or lot of land, with improvements thereon, if any, situate, lying and being in the City of Newberry, County of Newberry, State of South Carolina, being designated as Lot 17, Block H, as shown on plat of Wells Heights Development, recorded in Plat Book "S" at Page 73. Said lot fronting on Henry Avenue for a distance of One Hundred four (104') feet, more or less, and running back therefrom, along the line of Lot No. 16, Block H for a distance of Eighty-seven and 5/10 (87.5') )feet, more or less, thence running along the line of Lot 19 A, Block H, for a distance of Sixty-four (64.0') feet, more or less, and thence running along the line of Lot 18, Block H, for a distance of Seventy-eight and 8/10 (78.8') feet, more or less, to Henry Avenue, and having such shapes, courses, distances, metes and bounds as shown upon said plat, all measurements being a little more or less, to which reference is hereby craved as often as necessary for a more complete an accurate description. AND ALL THAT piece, parcel, or lot of land, with the improvements thereon, if any, situate, lying and being in the City of Newberry, County of Newberry, State of South Carolina, said lot being more particularly described as Lot No. Sixteen (16), Block H on a plat of Wells Heights Development recorded in the Office of the Clerk of Court for Newberry County in Plat Book "S" at Page 73. Said lot fronts Henry Avenue for a distance of Eighty-seven and five-tenths (87.5') feet, more or less; thence turning and running along the line of Lot 20 for a distance of Eighty-one and one-tenth (81.1') feet, more or less; and thence turning and running along the line of Lot 15 for a distance of One Hundred Eighteen and two-tenths (118.2') feet, more or less, and having ;such shapes, courses, distances, metes and bounds as shown upon said plat, all measurements being a little more or less, to which reference is hereby craved as often as necessary for a more complete and accurate description. THIS BEING the same property conveyed unto Uriel Pacheco-Contreras by virtue of a Deed from Toula Economos Hubbard dated January 5, 2022, recorded January 9, 2023 in Book 2486 at Page 144 in the Office of the Clerk of Court for Newberry County South Carolina. 2518 Henry Avenue Newberry, SC 29108 TMS# 341-1-21-8 TERMS OF SALE: For cash. Interest at the current rate of 6.625% to be paid on balance of bid from date of sale to date of compliance. The purchaser to pay for papers and stamps, and that the successful bidder or bidders, other than the Plaintiff therein, will, upon the acceptance of his or her bid, deposit with the Special Referee for Newberry County a certified check or cash in the amount equal to five percent (5%) of the amount of bid on said premises at the sale as evidence of good faith in bidding, and subject to any resale of said premises under Order of this Court; and in the event the said purchaser or purchasers fail to comply with the terms of sale within Thirty (30) days, the Special Referee for Newberry County shall forthwith resell the said property, after the due notice and advertisement, and shall continue to sell the same each subsequent sales day until a purchaser, who shall comply with the terms of sale, shall be obtained, such sales to be made at the risk of the former purchaser. Since a personal or deficiency judgment is waived, the bidding will not remain open but compliance with the bid may be made immediately. Plaintiff may waive any of its rights prior to sale. Sold subject to taxes and assessments, existing easements and restrictions of record. Neither the Court, nor Plaintiff, nor Plaintiff's counsel makes any warranty of title or representations with regard to the condition or existence of any improvements on the subject property.
