NOTICE OF SALE UNDER POWER GEORGIA, MUSCOGEE COUNTY Because of default in the payment of the indebtedness, secured by a Security Deed executed by Edward D. Inge and Marilyn H. Inge to Homecomings Financial Network, Inc., dated June 16, 2000, in the amount of $40,000.00, and recorded in Deed Book 5600, Page 262, Muscogee County, Georgia Records, and assigned to CadleRock Joint Venture, L.P. by assignment dated November 20, 2008, recorded in Deed Book 9576, Page 306, Muscogee County, Georgia Records; the undersigned, CadleRock Joint Venture, L.P. pursuant to said deed and the note thereby secured, has declared the entire amount of said indebtedness due and payable and pursuant to the power of sale contained in said deed, will on the first Tuesday in November, 2025, during the legal hours of sale, at the Courthouse door in Muscogee County, sell at public outcry to the highest bidder for cash, the property described in said deed to-wit: All that lot, tract or parcel of land situate, lying and being in the State of Georgia, County of Muscogee and city of Columbus, being known and distinguished as lot numbered eight (8), Block "C", Lindsay Creek Park Subdivision, according to a map or plat of said subdivision recorded in the Office of the Clerk of the Superior Court of Muscogee County, Georgia, in Plat Book 12, at folio 4, and according to plat made by Hobbs, Smith & Associates, Inc., C.E., dated January 4, 1979, and recorded in Plat Book 68, at folio 93, and being more particularly described as follows: Commencing at a point located at the intersection of the southeasterly line of Rigdon Road with the southerly line of Glenwood Drive; Thence running in and easterly direction along the southerly line of Glenwood Drive, a distance of 841.5 feet to a concrete monument, which said monument marks the point of beginning of the property hereinafter described; Thence north 87 degrees 20 minutes east and along the southerly line of Glenwood Drive, a distance of 80 feet to a concrete monument; thence south 02 degrees 40 minutes east and along the western line of lot 9, Block "C", Lindsay Creek Park Subdivision, a distance of 150 feet to a concrete monument; thence south 87 degrees 20 minutes southeastern corner of lot 7 of said block and subdivision; Thence north 02 degrees 40 minutes west and along the eastern line of lot 7, said block and subdivision, a distance of 150 feet to the point of beginning. Situated upon said property is dwelling number 3204 Glennwood Drive, according to the present system of numbering dwellings in Columbus, Georgia. This is the same identical property conveyed by warranty deed from Larry C. Lauderdale and Shirley A. Lauderdale to Edward D. Inge and Marilyn H. Inge dated July 21, 1987 and recorded September 3, 1987 in Deed Book 2855, Page 264 in the office of the Clerk of the Superior Court of Muscogee County, Georgia. which has the property address of 3204 Glenwood Drive, Columbus, Georgia 31906, together with all fixtures and other personal property conveyed by said deed. This sale will be held subject to that certain Security Deed dated January 15, 2014, in favor of Mortgage Electronic Registration Systems on behalf of Freedom Mortgage Corporation recorded in Deed Book 11164, Page 206. The sale will also be held subject to any unpaid taxes, assessments, rights-of-way, easements, protective covenants or restrictions, liens, and other superior matters of record which may affect said property. The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the security deed. Notice has been given of intention to collect attorneys' fees in accordance with the terms of the note secured by said deed. Notice has been also given, in writing and by certified mail, return receipt requested, to the borrower, of the name, address, and telephone number of the individual or entity who shall have full authority to negotiate, amend, and modify all terms of the Security Deed and the note thereby secured in accordance with O.C.G.A. Section 44-14-162.2(a). To the best knowledge and belief of the undersigned, the party in possession of the subject property is Edward D. Inge and Marilyn H. Inge. The proceeds of said sale will be applied to the payment of said indebtedness, the expense of said sale, all as provided in said deed, and the undersigned will execute a deed to the purchaser as provided in the aforementioned Security Deed.
