SUBSTITUTE TRUSTEE'S NOTICE OF FORECLOSURE SALE WHEREAS on October 25, 2024, Shirley Cook, executed a Deed of Trust to Pilger Title Company, as Trustee , and Mortgage Electronic Registration Systems, Inc., solely as nominee for Oval Mortgage, as Beneficiary, which Deed of Trust is on file and of record in the office of the Chancery Clerk of Harrison (Second Judicial District), Mississippi as Instrument Number 2024-0006648-T-J2; and WHEREAS, Mortgage Electronic Registration Systems, Inc., solely as nominee for Oval Mortgage assigned said Deed of Trust to NewRez LLC d/b/a Shellpoint Mortgage Servicing via an instrument filed October 30, 2024 and recorded as Instrument 2025-0004657-T-J2; and WHEREAS, Newrez LLC d/b/a Shellpoint Mortgage Servicing appointed Padgett Law Group as Substitute Trustee in place of the afore-mentioned original Trustee via an instrument dated September 24, 2025 and recorded as Instrument No. 2025-0006998-T-J2 in the office of the Chancery Clerk of Harrison (Second Judicial District) County, Mississippi; and WHEREAS, default has occurred in the payment of the indebtedness secured by said deed(s) of trust, and NewRez LLC d/b/a Shellpoint Mortgage Servicing, as beneficiary, has authorized and instructed Padgett Law Group as substitute trustee to foreclose said deed(s) of trust by advertisement and sale at public auction in accordance with the statutes made and provided therefor. THEREFORE, notice is hereby given that pursuant to the power of sale contained in said deed(s) of trust and in accordance with the statutes made and provided therefor, the said deed(s) of trust will be foreclosed and the property covered thereby and hereinafter described will be sold at public auction to the highest bidder for cash at the front steps of the South side of the Harrison (Second Judicial District) County Courthouse in Biloxi, Mississippi, and will sell within legal hours (being between the hours of 11:00 AM and 4:00 PM) on November 4, 2025, to satisfy the indebtedness now due under and secured by said deed(s) of trust. Padgett Law Group will convey only such title as vested in it as Substituted Trustee. The premises to be sold are described as: A parcel of land being located in Section 17, Township 7 South, Range 9 West, Harrison County, Second Judicial District, Mississippi, and better described as beginning at the Southwest corner of Lot 9, Block 1, FOREST COVE ESTATES, Harrison County, Mississippi, and run thence West 50 feet to the West margin of Evergreen Drive; run thence South along said West margin of Evergreen Drive a distance of 528 feet for the Point of Beginning; run thence West a distance of 145 feet to a point; thence South and parallel with Evergreen Drive a distance of 100 feet; thence East 145 feet to the West margin of Evergreen Drive; thence North along said Evergreen Drive a distance of 100 feet to the Point of Beginning also known as Parcel #3, Lot 8, Block 2, FOREST COVE ESTATES, an unrecorded plat. The successful bidder must tender full funds at the conclusion of the sale in the form of a certified check made payable or endorsed to Padgett Law Group. No personal checks will be accepted. To this end you must bring sufficient funds to outbid the lender and any other bidders. Insufficient funds will not be accepted. Amounts received in excess of the winning bid will be refunded. Padgett Law Group reserves the right to award the bid to the next highest bidders should the highest bidder fail to timely tender the total amount due.
