Ordinance NO. ORD-31-25 BY THE COUNCIL CORLESS, HALLYBURTON, MORALES, NASH, STEAD AND WILLITS. AN ORDINANCE DESCRIBING THE EXTERIOR BOUNDARIES AND REMOVING CERTAIN PROPERTIES RELATED TO THE USTICK DITCH LATERAL FROM THE BOISE MUNICIPAL IRRIGATION SYSTEM; DIRECTING THE BOISE CITY CLERK TO RECORD A CERTIFIED COPY OF THIS ORDINANCE IN THE OFFICE OF THE ADA COUNTY RECORDER; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the city of Boise City operates a Municipal Irrigation System pursuant to Idaho Code 50-1801 et seq; and, WHEREAS, by ORD-7-23 and ORD-45-23, the City incorporated parcels that are entitled to receive water from the Ustick Ditch into the Boise Municipal Irrigation System (BMIS) and/or are adjacent to the Ustick Ditch lateral and subject to the City’s rights of access thereto; and, WHEREAS, certain parcels do not have reasonable access to the delivery of water from the Ustick Ditch and desire to be excluded from Nampa Meridian Irrigation District assessment rolls and the City supports such request; and, WHEREAS, other parcels are entitled to the delivery of water from a delivery point other than the Ustick Ditch headgate and/or may have access to delivery of water from an irrigation source other than the Ustick Ditch; and, WHEREAS, such properties should, accordingly, be removed from the BMIS; and, WHEREAS, Idaho Code 50-1832 requires an ordinance describing the exterior boundaries of property to be incorporated into or removed from a municipal irrigation system. NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF BOISE CITY, IDAHO: Section 1. That the properties, as particularly described in Exhibit A and depicted in Exhibit B attached hereto, are hereby removed from the Boise Municipal Irrigation System and the outer boundaries of the Boise Municipal Irrigation System are adjusted accordingly. Section 2. That the Boise City Clerk be, and is hereby, directed to record a certified copy of this Ordinance in the Office of the Ada County Recorder. Section 3. That this Ordinance shall be in full force and effect immediately upon its passage, approval, and publication. ADOPTED by the Council of Boise City, Idaho, on September 30, 2025.
