The South Carolina Department of Environmental Services (SCDES) is accepting public comments on a proposed Voluntary Cleanup Contract through November 11, 2025.
The Voluntary Cleanup Contract, 25-8819-NRP, will affect approximately 36 acres located on Old York Road and Adnah Church Road, York, South Carolina. The property is further identified by York County Tax Map Serial Numbers 4980000002 (portion, 13.79 acres), 4980000037 (1.59 acres), 4980000074 (1.88 acres), 4980000075 (1.92 acres), 4980000005 (1.85 acres), 4980000009 (9.44 acres), 4980000060 (portion, 3.18 acres). A company known as RP Newport Commons, LLC (“Newport”) wants to acquire the property and intends to develop it into commercial and retail space.
The property was previously used for residential housing. Sites to the north and east of the property were previously used or are currently used for fueling and auto repair operations. The past use of the property, or surrounding properties, may have caused environmental pollution on the property.
SCDES uses Voluntary Cleanup Contracts to encourage productive reuse of Brownfield sites. If this Voluntary Cleanup Contract is implemented, SCDES will allow Newport to acquire the property as a “Brownfields Property” because of the potential for environmental pollution from past activity on the property.
SCDES will not hold Newport responsible for pre-existing pollution in exchange for doing work under the Voluntary Cleanup Contract. Under the proposed contract, Newport will test soil, groundwater, and soil vapor on the property. If significant contamination is found, Newport will be required to take steps to protect human health and the environment. Newport did not create the pollution but will control it to keep the property safe for re-use. Under State law, Newport will not be responsible if anyone has been affected by the contamination. The responsibility of former owners or operators of the property is not reduced by this contract.
