NOTICE OF SALE UNDER POWER Under and by virtue of the power of sale contained in the Deed to Secure Debt and Security Agreement made and entered by and between TMF Macon Portfolio, LLC, a Georgia limited liability company, as to an undivided 90.66% interest, Yates Macon, LLC, a Delaware limited liability company, as to an undivided 2.92% interest, and SNT 2014 Family, LLC, a Delaware limited liability company, as to an undivided 6.42% interest, as tenants in common (collectively, the "Grantors"), and ReadyCap Commercial, LLC, a Delaware limited liability company, dated October 20, 2022, recorded on October 21, 2022, in Deed Book 11415, Page 28 in the records with the Bibb County, Georgia Superior Court Clerk; as assigned to READYCAP WAREHOUSE FINANCING III LLC, a Delaware limited liability company, by instrument recorded on November 9, 2022 in Deed Book 11428 at Page 49, aforesaid records, as assigned to RCH TERM HOLDINGS, LLC, a Delaware limited liability company, by instrument recorded on January 9, 2025 in Deed Book 12048 at Page 128, aforesaid records; as assigned to RC Macon Portfolio REO, LLC, a Delaware limited liability company ("Grantee"), by instrument recorded on October 1, 2025 in Deed Book 12263, at Page 15, aforesaid records (collectively, as assigned, the "Security Deed"), which Security Deed secures certain indebtedness and obligations of Grantors due and owing to Grantee, including, without limitation, the obligations of Grantors under that certain Promissory Note dated October 20, 2022, in the original principal amount of $9,000,000.00, executed by Grantors, as borrowers, in favor of and payable to the order of ReadyCap Commercial, LLC, as lender (as subsequently endorsed and assigned to Grantee, the "Note"), there will be sold by the Grantee, as attorney-in-fact for the Grantors, at public outcry to the highest bidder for cash before the courthouse door in Bibb County, Georgia, within the legal hours of sale on the first Tuesday in November, 2025, the following described property informally known as the Macon Portfolio and located at 365 Rogers Ave, Macon, GA; 4171 & 4179 Log Cabin Drive, Macon, GA; 4151 Log Cabin Drive, Macon, GA, and 520 Baxter Avenue, Macon, GA (collectively, the "Property"): Parcel 1 (365 Rogers Avenue, Macon, Bibb County, Georgia 31204): ALL THAT TRACT or parcel of land lying and being in Bibb County, being known and designated as Briarwood Apartments located at 365 Rogers Avenue, Macon, Georgia, and being shown on a survey for Briarwood Apartments, LLC dated April 22, 2009, prepared by Theodore W. Waddle, Sr., as more particularly depicted on a plat recorded in Plat Book 93, Page 295, Records of Bibb County, Georgia, which plat is incorporated herein by reference hereto. Parcel 2 (4171 & 4179 Log Cabin Drive, Macon, Bibb County, Georgia 31204): All those tracts or parcels of land situate, lying and being in Land Lot 112, 4th Land District, Bibb County, Georgia, being known and designated as Lot C, containing 0.46 acres and Lot D, containing 0.60 acres of the property of R. Dennard Solomon, according to a plat prepared by Thomas H. Winchester, Jr., RS#757 dated August 27, 1968 and recorded in Plat Book 44, Page 26, Clerk's Office, Bibb Superior Court. Said lots are subject to such size, shape, metes, bounds and dimensions as shown on said plat, which plat is by this reference made a part hereof for all purposes. Parcel 3 (4151 Log Cabin Drive, Macon, Bibb County, Georgia 31204): ALL THAT TRACT OR PARCEL OF LAND situate, lying and being in the Land Lot A, Lot 112 of the 4th land District, Bibb County, Georgia, being known and designated as "Tara Apartments Site" and "Charles A. McGlamry", according to a plat prepared by Broxton Surveying Co., dated 10/07/1970 recorded in Plat Book 47, Page 37, Clerk's Office, Bibb Superior Court. Said Lot 112 is subject to such size, shape, metes, bounds and dimensions as shown on said plat, which plat is by this reference made a part hereof for all purposes. Parcel 4 (520 Baxter Avenue, Macon, Bibb County, Georgia 31201): ALL THAT TRACT or parcel of land lying and being in Land Lot 7 of the Macon Reserve West of Bibb County, Georgia, being more particularly shown and designated as Tract 1 containing 3.751 acres, upon a Boundary survey for FSF Holdings, LLC, prepared by Richard Clinton Strange, a Georgia Land Surveyor No. 3067, dated August 5, 2009, as more particularly depicted on a plat recorded in Plat Book 92, Page 956, Records of Bibb County, Georgia, which plat is incorporated herein by reference hereto. LESS AND EXCEPT from the above-described property that portion of the property conveyed by that certain Right of Way Deed from A.E. Barnes, III to Bibb County, Georgia, a political subdivision, dated January 10, 1997, recorded in Deed Book 3053, Page 247, Records of Bibb County, Georgia. The real property described in this Notice of Sale Under Power is referred to herein as the "Land," and is being sold with all other property described in Section 1.1 of the Security Deed. All capitalized terms used but not defined in this notice have the meanings ascribed to such terms in the Security Deed. Each person bidding for the Property will be asked to identify the portion of his or her bid price attributable to the portion of the Property constituting a real property interest under Georgia law, and that portion of his or her bid price attributable to the portion of the Property constituting personal property under Georgia law. Grantors defaulted under the terms of the Note and Security Deed by failing to timely pay the amounts due thereunder, among other things. The entire outstanding principal sum evidenced by the Note, together with all accrued but unpaid interest thereon, is now due and payable. The Note remaining in default, the above sale will be made for the purpose of applying the proceeds to the payment of the Note, accrued interest thereon through the date of sale, all expenses of the sale, and all other payments provided for under the Note and the Security Deed and by law, and the remainder of such proceeds, if any, shall be applied as provided by law. To the best of the undersigned's knowledge and belief, Grantors and/or their tenant(s) are the party / parties in possession of the Property. The Property will be sold as the property of Grantors, subject to any unpaid ad valorem taxes and governmental assessments (including taxes which are a lien, but not yet due and payable); zoning ordinances and governmental restrictions; the rights of tenants under written leases that are not then in default; and any liens, restrictions, covenants, rights-of-way, easements, leases, declarations, and other encumbrances that appear of record prior to the Security Deed.
