NOTICE OF SALE UNDER POWER, BIBB COUNTY Pursuant to the power of sale contained in the Security Deed executed by DENNIS A. GARDNER AKA DENNIS ALEXANDER GARDNER AND LISA GARDNER to SUPERIOR BANK FSB DUNNE MORTGAGE DIVISION in the original principal amount of $78,880.00 dated September 18, 1997, and recorded in Deed Book 4038, Page 138, Bibb County records, said Security Deed being last transferred to U.S. BANK, NATIONAL ASSOCIATION, AS TRUSTEE FOR THE AFC MORTGAGE LOAN ASSET BACKED CERTIFICATES, SERIES 1997-4 in Deed Book 12087, Page 122, Bibb County records, the undersigned will sell at public outcry to the highest bidder for cash, before the Courthouse door in said County, or at such other place as lawfully designated, within the legal hours of sale, on 11/4/2025, the property in said Security Deed and described as follows: ALL THAT TRACT OR PARCEL OF LAND LYING AND BEING IN LAND LOT 203 OF THE 13TH LAND DISTRICT OF BIBB COUNTY, GEORGIA, AND BEING DESIGNATED AS LOT 174, UNIT VI, LAKE WILDWOOD SUBDIVISION, AS SHOWN ON A PLAT OF A SUBDIVISION SURVEY THEREOF, RECORDED IN PLAT BOOK 58, PAGES 11 THROUGH 16, CLERK'S OFFICE, BIBB SUPERIOR COURT, WHICH PLAT BY THIS REFERENCE THERETO IS INCORPORATED HEREIN FOR A MORE PARTICULAR AND ACCURATE DESCRIPTION OF SAID PROPERTY. THERE IS A DWELLING LOCATED THEREON KNOWN UNDER THE PRESENT SYSTEM OF NUMBERING AS 1149 KING ARTHUE DRIVE MACON, GEORGIA. Said property being known as: 1149 KING ARTHUR DRIVE, MACON, GA 31220 To the best of the undersigned's knowledge, the party or parties in possession of said property is/are DENNIS A. GARDNER AKA DENNIS ALEXANDER GARDNER AND LISA GARDNER or tenant(s). The debt secured by said Security Deed has been and is hereby declared due and payable because of, among other possible events of default, failure to pay the indebtedness as provided for in the Note and said Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of sale, including attorney's fees (notice of intent to collect attorney's fees having been given). Said property will be sold subject to the following: (1) any outstanding ad valorem taxes (including taxes which are a lien, whether or not yet due and payable); (2) the right of redemption of any taxing authority; (3) any matters which might be disclosed by an accurate survey and inspection of the property; and (4) any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.
