STATE OF GEORGIA COUNTY OF MUSCOGEE NOTICE OF SALE UNDER POWER Pursuant to the power of sale contained in the Security Deed executed by JOHN HENRY HODGES AND ERSALINE HODGES to BENEFICIAL MORTGAGE CO. OF GEORGIA in the original principal amount of $101,000.27 dated November 19, 2007, and recorded in Deed Book 9178, Page 38, Muscogee County records, said Security Deed being last transferred to U.S. BANK TRUST COMPANY, NATIONAL ASSOCIATION, NOT IN ITS INDIVIDUAL CAPACITY BUT SOLELY IN ITS CAPACITY AS INDENTURE TRUSTEE OF CIM TRUST 2025-NR1 in Deed Book 14722, Page 405, Muscogee County records, the undersigned will sell at public outcry to the highest bidder for cash, before the Courthouse door in said County, or at such other place as lawfully designated, within the legal hours of sale, on 11/4/2025, the property in said Security Deed and described as follows: ALL THAT LOT, TRACT OR PARCEL OF LAND SITUATE, LYING AND BEING IN COLUMBUS MUSCOGEE COUNTY, GEORGIA AND BEING KNOWN AND DESIGNATED AS ALL OF LOT ONE (1) IN BLOCK 'F' OF THAT CERTAIN SUBDIVISION OF LAND KNOWN AS SECTION TWO, BELVEDERE PARK AS SAID LOT IS SHOWN UPON A MAP OR PLAT RECORDED IN PLAT BOOK 34 FOLIO 70-A IN THE OFFICE OF THE CLERK OF THE SUPERIOR COURT OF MUSCOGEE COUNTY, GEORGIA TO WHICH REFERENCE WAS MADE FOR A MORE PARTICULAR DESCRIPTION OF THE PROPERTY HEREIN CONVEYED. TAX MAP OR PARCEL ID NO.: 095-042-001 Said property being known as: 758 BAXLEY WAY, COLUMBUS, GA 31907 To the best of the undersigned's knowledge, the party or parties in possession of said property is/are JOHN HENRY HODGES AND ERSALINE HODGES or tenant(s). The debt secured by said Security Deed has been and is hereby declared due and payable because of, among other possible events of default, failure to pay the indebtedness as provided for in the Note and said Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of sale, including attorney's fees (notice of intent to collect attorney's fees having been given). Said property will be sold subject to the following: (1) any outstanding ad valorem taxes (including taxes which are a lien, whether or not yet due and payable); (2) the right of redemption of any taxing authority; (3) any matters which might be disclosed by an accurate survey and inspection of the property; and (4) any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.
