STATE OF FLORIDA MIAMI-DADE COUNTY DEPARTMENT OF REGULATORY & ECONOMIC RESOURCES DIVISION OF ENVIRONMENTAL RESOURCES MANAGEMENT NOTICE OF PROPOSED AGENCY ACTION The Miami-Dade County Department of Regulatory & Economic Resources ("RER") Division of Environmental Resources Management ("DERM") gives notice that it proposes to approve a No Further Action Proposal with Engineering and Institutional Controls and issue a Site Rehabilitation Completion Order with Conditions for a contaminated site. Solimar Associates, Ltd., is seeking this order in reference to Site ID# BF132001001, the Solimar Apartments Green Reuse Site (located at 805, 815, 825, 835, 905, 915, 1005, 1015, 1025 NW 5th Ave, Florida City, FL 33034 (Folio No.: 16-7824-045-0010) (DERM case number HWR-01016) and intends to restrict exposure to contamination in the following manner: a Declaration of Restrictive Covenant between the Owner (Solimar Associates, Ltd.) and Miami-Dade County, that will encumber the property by requiring Engineering Controls to cover the entire parcel to prevent exposure to contaminated soil, and by restricting use of the groundwater at the property. Complete copies of the No Further Action Proposal, the proposed Institutional Control (i.e., a draft Declaration of Restrictive Covenant), and DERM's preliminary evaluation are available for public inspection online in the DERM's Record Management System at https://ecmrer.miamidade.gov/document-search using DERM's case number HWR-01016. Please use DERM's case number HWR-01016 and the Site ID # BF132001001 listed on the DERM's preliminary evaluation to communicate with DERM about this site. Local governments with jurisdiction over the property subject to the Institutional or Engineering Control, real property owner(s) of any property subject to the Institutional or Engineering Control, residents or business tenants of any property subject to the Institutional or Engineering Control, and any party holding a materially affected encumbrance in the area subject to the control have 30 days from publication of this notice to provide comments to the DERM.
