WHATCOM COUNTY NOTICE OF APPLICATION FOR A LAND FILL AND GRADE AND INTENT TO ISSUE A SEPA MITIGATED DETERMINATION OF NON-SIGNIFICANCE Notice is hereby given that on September 8, 2025, Tyler Gage and Nick Palewicz applied for a Land Fill and Grade under case number LFG2025-00068 to Construction of a private access road to serve ten lots which will be revised per a boundary line adjustment. Approximately 44 acres of vegetation and trees onsite has been cleared under a DNR FPA, this area will be converted to allow residential development. Additional spot removal of trees and grubbing will be required to provide access to lots and home sites where there is no existing logging road. Utilities which will be installed to support the development include electrical power from Puget Sound Energy, and communications. The application was determined complete on September 17, 2025. The project site is located at 4994 Samish Way, Bellingham, within Section 16, Township 37 North, Range 03 East of W.M.; Assessor's Parcel No: 3703165173010000. The project will be reviewed under the Official Whatcom County Zoning Ordinance and Title 24, Title 22, Title 21, Title 20, Title 17, Title 16, International Building Code (IBC), Title 12, Whatcom County Development Standards, Washington State Stormwater Manual and State Environmental Policy Act (SEPA) as applicable. Mitigation may be required pursuant to these ordinances. Whatcom County Planning and Development Services has reviewed the proposal for probable adverse impacts and expects to issue a Mitigated Determination of Non-Significance (DNS) for the project pursuant to the Optional MDNS process per WAC 197-11-355. This may be your only opportunity to comment on the environmental impacts of the proposed project. A copy of the subsequent threshold determination for the specific proposal may be obtained upon request.
