SUBSTITUTE TRUSTEE'S NOTICE OF FORECLOSURE SALE
WHEREAS on July 30, 2020, TYREE HARRINGTON AND DARNITA HARRINGTON, AS JOINT TENANTS WITH FULL RIGHTS OF SURVIVORSHIP, AND NOT AS TENANTS IN COMMON, executed a Deed of Trust to 6JEFFREY WAGNER, as Trustee, and WELLS FARGO BANK, N.A., as Beneficiary, which Deed of Trust is on file and of record in the Office of the Chancery Clerk of Jackson County, Mississippi; and
WHEREAS, Wells Fargo Bank, N.A. assigned said Deed of Trust to NewRez LLC dba Shellpoint Mortgage Servicing via an instrument filed on February 5, 2025 and recorded in Book 4127, Page 366 – and as Instrument Number 202501893 – in the Office of the Chancery Clerk of Jackson County, Mississippi; and
WHEREAS, NewRez LLC dba Shellpoint Mortgage Servicing appointed Padgett Law Group as Substitute Trustee in place of the afore-mentioned original Trustee via an instrument filed on September 11, 2025 and recorded in Book 4182, Page 649 – and as Instrument Number 202518352 – in the Office of the Chancery Clerk of Jackson County, Mississippi; and
WHEREAS, default has occurred in the payment of the indebtedness secured by said deed(s) of trust, and NewRez LLC dba Shellpoint Mortgage Servicing, as beneficiary, has authorized and instructed Padgett Law Group as substitute trustee to foreclose said deed(s) of trust by advertisement and sale at public auction in accordance with the statutes made and provided therefor.
THEREFORE, notice is hereby given that pursuant to the power of sale contained in said deed(s) of trust and in accordance with the statutes made and provided therefor, the said deed(s) of trust will be foreclosed and the property covered thereby and hereinafter described will be sold at public auction to the highest bidder for cash at the West front door of the Jackson County Courthouse, at Pascagoula, Mississippi, and will sell within legal hours (being between the hours of 11:00 AM and 4:00 PM) on October 29, 2025, to satisfy the indebtedness now due under and secured by said deed(s) of trust.
Padgett Law Group will convey only such title as vested in it as Substituted Trustee.
The premises to be sold are described as:
Lot 35, WINDSOR PARK SUBDIVISION, Unit 16, Jackson County, Mississippi, as per map or plat thereof on file and of record in the office of the Chancery Clerk of Jackson County, Mississippi, in Plat Book 14, Page 50.
The successful bidder must tender full funds at the conclusion of the sale in the form of a certified check made payable or endorsed to Padgett Law Group. No personal checks will be accepted. To this end you must bring sufficient funds to outbid the lender and any other bidders. Insufficient funds will not be accepted. Amounts received in excess of the winning bid will be refunded. Padgett Law Group reserves the right to award the bid to the next highest bidders should the highest bidder fail to timely tender the total amount due.
