SUBSTITUTE TRUSTEE'S NOTICE OF FORECLOSURE SALE WHEREAS on September 18, 2014, Joseph Brian Russell, single, executed a Deed of Trust to W. Stewart Robison, as Trustee , and Green Tree Servicing, LLC, as Beneficiary, which Deed of Trust is on file and of record in the office of the Chancery Clerk of Jackson County, Mississippi, in DT Book 3236, Page 502 – and as Instrument Number 201414752; and WHEREAS, Green Tree Servicing, LLC assigned said Deed of Trust to has been duly transferred and assigned to Walter Investment Management Corp. via an instrument dated October 30, 2014; filed on November 7, 2014, and recorded in Book 3243, Page 890 – and as Instrument No. 201416693 - in the office of the Chancery Clerk of Jackson County, Mississippi; and WHEREAS, Walter Investment Management Corp. attempted to document its Assignment of the subject Deed of Trust (filed on October 2, 2014 and recorded in Book 3236, Page 502 in the Office of the Chancery Clerk of Jackson County, Mississippi) to CitiBank, N.A., not in its individual capacity, but solely as Trustee of NRZ Pass-Through Trust VI by way of an Affidavit of Lost Assignment filed August 5, 2022 and recorded in Book 3928, Page 643 in the Office of the Chancery Clerk of Jackson County, Mississippi; and WHEREAS, the Chancery Court of Jackson County, Mississippi determined that the afore-mentioned Affidavit of Lost Assignment an effective means of continuing the mortgage chain of title as memorialized within a Declaratory Judgment entered August 13, 2025 in Jackson County Chancery Court No. 30CH1:25-cv- 00277-DNH (U.S. Bank Trust National Association, not in its individual capacity but as Owner Trustee for GSMS 2021-1 vs. Joseph Brian Russell); and WHEREAS, the afore-mentioned Declaratory Judgment was filed on September 17, 2025 and recorded in Book 2229, Page 392 – and as Instrument No. 202518678 - in the Office of the Chancery Clerk of Jackson County, Mississippi; and WHEREAS, CitiBank, N.A., not in its individual capacity, but solely as Trustee of NRZ Pass-Through Trust VI assigned the subject Deed of Trust to Goldman Sachs Mortgage Company via an instrument filed Au- gust 9, 2023 and recorded in Book 4011, Page 792 – and as Instrument No. 202315464 - in the Office of the Chancery Clerk of Jackson County, Mississippi; and WHEREAS, Goldman Sachs Mortgage Company assigned said Deed of Trust to U.S. Bank Trust Na- tional Association, not in its individual capacity but as Owner Trustee for GSMS 2021-1 Trust via an instrument dated April 12, 2024, filed May 1, 2024 and recorded in Book 4065, Page 752 – and as Instrument No. 202407502 - in the Office of the Chancery Clerk of Jackson County, Mississippi; and WHEREAS, U.S. Bank Trust National Association, not in its individual capacity but as Owner Trustee for GSMS 2021-1 Trust appointed Dean Morris, LLC as Substitute Trustee in place of the afore-mentioned original Trustee via an instrument dated September 5, 2024, filed September 9, 2024 and recorded in Book 4096, Page 211 – and as Instrument No. 202417039 – in the Office of the Chancery Clerk of Jackson County, Mississippi; and WHEREAS, U.S. Bank Trust National Association, not in its individual capacity but as Owner Trustee for GSMS 2021-1 Trust appointed Padgett Law Group as Substitute Trustee in place of the afore-mentioned original Trustee and substituted Trustee via an instrument dated January 27, 2025, filed January 30, 2025 and recorded in Book 4126, Page 45 – and as Instrument No. 202501466 – in the Office of the Chancery Clerk of Jackson County, Mississippi; and WHEREAS, default has occurred in the payment of the indebtedness secured by said deed(s) of trust, and U.S. Bank Trust National Association, not in its individual capacity but as Owner Trustee for GSMS 2021-1 Trust, as beneficiary, has authorized and instructed Padgett Law Group as substitute trustee to foreclose said deed(s) of trust by advertisement and sale at public auction in accordance with the statutes made and provided therefor. THEREFORE, notice is hereby given that pursuant to the power of sale contained in said deed(s) of trust and in accordance with the statutes made and provided therefor, the said deed(s) of trust will be foreclosed and the property covered thereby and hereinafter described will be sold at public auction to the highest bidder for cash at the main front door of the Circuit Court Building, 3104 Magnolia, Pascagoula, Jackson County, Mississippi, and will sell within legal hours (being between the hours of 11:00 AM and 4:00 PM) on October 29, 2025, to satisfy the indebtedness now due under and secured by said deed(s) of trust. The premises to be sold are described as: That certain tract or parcel of land situated in Louis Alexis Claim Section 7, Township 7 South, Range 6 West, Jackson County, Mississippi, and being more particularly described as: Beginning at an iron pin marking the Northwest comer of Lot 44 of Driftwood Park, a subdivision of record in Plat Book 5, Page 39, of the record of plats on file in the Office of the Chancery Clerk of Jackson County," Mississippi; thence run South along the West line of Lots 44 and 45 a distance of 100.0 feet to the Southwest corner of said Lot 45, said point being the Northeast comer of the Kristopher A. Mitchell property as recorded in Book 1335, Page 383, Land Deed Records of Jackson County, Mississippi; thence run West along the North line of said Kristopher A. Mitchell property a distance of 100.0 feet; thence run North a distance of 100.0 feet; thence run East a distance of 100.0 feet to the point of beginning. And Also: A perpetual non-exclusive right to ingress and egress along a road right of way, 50 feet in width, and being described as: Beginning at a point on Borries Road (Roy's Road/Roy Borries Road), 101.5 feet West of the Northwest corner of Lot 40 of Driftwood Park, a subdivision of record in Plat Book 5, Page 39 of the record of plats on file in the Office of the Chancery Clerk of Jackson County, Mississippi; thence South a distance of 496.91 feet to a point 100.0 feet West of the Southwest corner of Lot 47 of said Driftwood Park Subdivision; thence run West a distance of 50.0 feet along the North line of property now or formerly owned by the Ocean Springs Volunteer Fire Company, thence North a distance of 496.91 feet, more or less, to the South margin of Borries Road; thence East along said South margin of Borries Road a distance of 50.0 feet, more or less, to the point of beginning. The successful bidder must tender full funds at the conclusion of the sale in the form of a certified check made payable or endorsed to Padgett Law Group. No personal checks will be accepted. To this end you must bring sufficient funds to outbid the lender and any other bidders. Insufficient funds will not be accepted. Amounts received in excess of the winning bid will be refunded.
