Public Notice of Application for Consistency Determination Under the Coastal Zone Management Act SL Coastal, LLC has filed notice of a proposed project which requires review by the MS Department of Marine Resources to ensure compliance with the state's approved Coastal Program under the Coastal Zone Management Act. The applicant is proposing to fill 6.37 acres of non-tidal wetlands and 0.26 acre of Other Waters of the U.S. (OWUS) for construction of Phase 2 of an existing subdivision near Seaman Road, in St. Martin, Jackson County, MS. The applicant is also proposing to impact 0.18-acre of OWUS to grade to allow for natural conversion of the 0.18-acre to wetland habitat. The applicant is also seeking after-the-fact approval of 0.32 acre of non-tidal wetland fill in Phase 1 of the subdivision. The MDMR previously reviewed and found 8.4 acres of fill into non-tidal wetlands consistent with MDMR's Coastal Program. If the 0.32 acre impact is approved, the total impact for Phase 1 of the subdivision will be 8.72 acres of fill into nontidal wetlands.
