NOTICE OF SALE NOTICE OF SALE CIVIL ACTION NO. 2024-CP-07-00436 BY VIRTUE of the decree heretofore granted in the case of: Lakeview Loan Servicing, LLC vs. Brantley Travis Polk; Maria N. Bagnulo; Melvin McCarthan, Jr.; Malind Bluff Homeowners Association, Inc.; South Carolina Department of Revenue; American Express National Bank, the undersigned Special Referee for Beaufort County, South Carolina, will sell on October 8, 2025 at 11:00 AM, or on another date, thereafter as approved by the Court, at the Courthouse, City of Beaufort, State of South Carolina, to the highest bidder: All that certain piece, parcel or lot of land, known as Lot 35 lying and being in the County of Beaufort, State of South Carolina, as shown and designated on a plat entitled "A SUBDIVISION PLAT OF PARCEL 1: LOTS 1-100 PHASE 1 MALIND BLUFF A PORTION OF TAX PARCEL NO. R600-013-000-0378-0000 CHERRY POINT, BEAUFORT COUNTY", prepared by ATLAS SURVEYING, INC. certified by Jeremy W. Reeder, SCRLS No. 28139, and recorded in the Office of the Register of Deeds for Beaufort County, South Carolina, in Plat Book 156, Pages 180-184. For a more detailed description as to location metes, bounds, distances, direction, etc., reference may be had to said plat of record. This property is conveyed by the Grantor and accepted by the Grantee subject to all applicable covenants, conditions, restrictions, easements, affirmative obligations, previously reserved or conveyed rights, titles and interests, etc., which constitute covenants running with the land and recorded in the Office of the Register of Deeds for Beaufort County, South Carolina. This being the same property conveyed to Brantley Travis Polk and Maria N. Bagnulo, as joint tenants with rights of survivorship, and not as tenants in common, by Deed of Pulte Home Company, LLC, a Michigan Limited Liability Company, dated December 17, 2021, and recorded January 19, 2022, in Book 4106, Page 607 in the Records for Beaufort County, South Carolina. CURRENT ADDRESS OF PROPERTY: 82 Dudley Ave, Bluffton, SC 29909 TMS: R600-013-000-0413-0000 TERMS OF SALE: The successful bidder, other than the Plaintiff, will deposit with the Special Referee, at conclusion of the bidding, five percent (5%) of his bid, in cash or equivalent, as evidence of good faith, same to be applied to the purchase price in case of compliance, but in the case of non-compliance to be forfeited and first applied to the costs incurred by the Plaintiff related to the sale and the balance then applied to the Plaintiff's debt in a manner suitable to the Plaintiff. Should the last and highest bidder fail to comply with the other terms of the bid within thirty (30) days, then the Special Referee may re-sell the property on the same terms and conditions on some subsequent Sales Day. Deficiency judgment being demanded, the bidding will not be closed on the day of sale but will remain open for a period of thirty (30) days as provided by law. Plaintiff is demanding a deficiency. The Plaintiff may waive any of its rights, including its right to a deficiency judgment, prior to sale. Purchaser to pay for documentary stamps on the Deed. The successful bidder will be required to pay interest on the amount of the balance of the bid from date of sale to date of compliance with the bid at the rate of 3.375% per annum. The sale shall be subject to taxes and assessments, existing easements and restrictions, easements and restrictions of record and any other senior encumbrances.
