WHATCOM COUNTY NOTICE OF APPLICATION FOR A SHORELINE SUBSTANTIAL DEVELOPMENT PERMIT, SHORELINE VARIANCE, CONDITIONAL USE PERMIT AND INTENT TO ISSUE A SEPA DETERMINATION OF NON-SIGNIFICANCE Notice is hereby given that on June 15, 2022, Blaine Birch Bay Park District 2 applied for a Shoreline Substantial Development Permit, Conditional Use Permit and SEPA Environmental Checklist under case numbers SHR2021-00016, CUP2022-00008 and SEP2021-00088. On July 24, 2025, they amended the project and submitted a Shoreline Variance under case number SHV2025-00001. The project is to develop California Creek Estuary Park, a new 44-acre park with ADA accessible interpretive trail loop, educational kiosk, parking lot, restrooms, picnic pavilion, playground, and dock for kayak launch to access California Creek. The proposed dock extends 50 ft. from the OHWM and is comprised of an 8' x 52' gangway leading to a 14' x 18' float. The application was determined complete on December 2, 2022 for the initial submittal, and again on July 24, 2025 after the Shoreline Variance submittal. The project site is located at 4677 & 4656 Drayton Harbor Rd., within Section 18, Township 40N, Range 01E of W.M.; Assessor's Parcel No: 400118332411, 400118353352 and 400118350198. The project will be reviewed under the Official Whatcom County Zoning Ordinance and Title 24, Title 22, Title 21, Title 20, Title 17, Title 16, International Building Code (IBC), Title 12, Whatcom County Development Standards, Washington State Stormwater Manual and State Environmental Policy Act (SEPA) as applicable. Mitigation may be required pursuant to these ordinances. Whatcom County Planning and Development Services has reviewed the proposal for probable adverse impacts and expects to issue a Determination of Non-Significance (DNS) for the project pursuant to the Optional DNS process per WAC 197-11-355. This may be your only opportunity to comment on the environmental impacts of the proposed project. A copy of the subsequent threshold determination for the specific proposal may be obtained upon request. The file and supporting documents may be viewed at the Whatcom County Planning and Development Services office at 5280 Northwest Drive, Bellingham, WA or at http://www.whatcomcounty.us/2914/Public-Notice.
