SUMMONS AND NOTICES STATE OF SOUTH CAROLINA COUNTY OF BEAUFORT PALM FINANCIAL SERVICES, LLC Plaintiff, vs. FRANCIS E. PURKEY Defendants. IN THE COURT OF COMMON PLEAS FOR THE FOURTEENTH JUDICIAL CIRCUIT C/A No. 2025CP0700604 (Non-Jury Foreclosure of Certificate of Lien) SUMMONS AND NOTICES TO THE DEFEDANT(S) ABOVE-NAMED: YOU ARE HEREBY SUMMONED and required to answer the complaint herein, a copy of which is herewith served upon you, and to serve a copy of your answer to this complaint upon the Plaintiff's attorney, MDK Legal LLC at P. O. Box 165028, Columbus, OH 43216-5028, within thirty (30) days after service hereof, exclusive of the day of such service, and if you fail to answer the complaint within the time aforesaid, judgment by default will be rendered against you for the relief demanded in the complaint. Your answer must be in writing and signed by you or your attorney and you must state your address or the address of your attorney, if signed by your attorney. NOTICE OF FILING COMPLAINT AND LIS PENDENS: NOTICE IS HEREBY GIVEN that the original Complaint in the above entitled action, together with the Summons and Lis Pendens, was filed in the Office of the Clerk of Court for Beaufort County on March 12, 2025. The Plaintiff has instituted this in rem action seeking to foreclose a Certificate of Lien recorded recorded July 3, 2024 in Instrument Number 2024029804, and recorded in Book 161, Page 1968 of the Public Records of Beaufort County, South Carolina for the amounts due and owing to the Plaintiff for the common expenses of the horizontal property regime due under the Master Deed and By-Laws of Disney Vacation Club at Hilton Head Island with respect to the property described as follows: An undivided 0.1812% interest in Unit 13A of Disney Vacation Club at Hilton Head Island Horizontal Property Regime, (the "Condominium"), according to the Master Deed thereof as recorded in Deed Book 804, Page 1432, in the Office of the Register of Deeds for Beaufort County, South Carolina, and all amendments thereto (the 'Master Deed') (Contract No.: 3000873.1). The civil case number for the foreclosure is 2025CP0700604. YOU WILL ALSO TAKE NOTICE that pursuant to Rule 53(b) SCRCP, as amended effective September 1, 2002, the Plaintiff will move for a general Order of Reference to the Master in Equity for Beaufort County, which Order shall, pursuant to Rule 53(b) of the South Carolina Rules of Civil Procedure, specifically provide that the said Master in Equity is authorized and empowered to enter a final judgment in this action. If there are counterclaims requiring a jury trial, any party may file a demand under rule 38, SCRCP and the case will be returned to the Circuit Court. NOTICE PURSUANT TO THE FAIR DEBT COLLECTION PRACTICES ACT (15 U.S.C. § 1692 et seq.): This is an attempt to collect a debt and any information you provide will be used for that purpose. However, if you have previously received a discharge from bankruptcy, this notice is for compliance and informational purposes only is not and should be construed as an attempt to collect a debt.
