NOTICE OF FINDING OF NO SIGNFICANT IMPACT AND NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS September 17, 2025 City of Livingston Community Development Department 1416 C Street Livingston, CA 95334 This notice shall satisfy two separate but related procedural requirements for activities to be undertaken by the City of Livingston REQUEST FOR RELEASE OF FUNDS On or about October 3, 2025, the City of Livingston will submit a request to the U.S. Department of Housing and Urban Development (HUD) for the release of Section 8 Project-Based Vouchers (PBV) under Section 8(o)(13) of the Housing and Community Development Act of 1937 (42 U.S.C. Section 1437f[o][13]), as amended, to undertake a project known as the Tierrasanta Villas Apartments Project (proposed project) in the City of Livingston. The 3.98-acre project site is located at 915 B Street in the City of Livingston, California, and is identified by Assessor's Parcel Number (APN) 022-010-026. The project site is within a vacant area of northwestern Livingston and is bounded by B Street to the south and State Route (SR) 99 and undeveloped land to the north. Surrounding existing uses include undeveloped land, an unpaved access road, and SR 99 to the north; single-family residences to the east; a Livingston Union School District (LUSD) facility and Selma Herndon Elementary School to the south, across B Street; a Sikh temple to the southwest, across B Street; and the Hammatt Lateral, a canal owned by the Merced Irrigation District, to the west. The site is designated High Density Residential by the City of Livingston 2040 General Plan and is zoned High Density Residential (R-3). The proposed project would include the development of an approximately 90,316-square-foot (sf) apartment complex consisting of five residential buildings including 80 affordable housing units, totaling approximately 83,120 sf of residential space. Three of the residential buildings would be two stories in height, and the other two would be three stories. Of the 80 units, 48 units would be 945-sf two-bedroom units and 32 units would be 1,180-sf three-bedroom units. The proposed project would be restricted to households earning 30 to 50 percent of the area median income (AMI) for Merced County. With respect to on-site amenities, the proposed project would also include an approximately 7,196-sf community center building for apartment residents. Approximately 4,907 sf of the community center building would include staff and leasing offices, a community room with a kitchen, and a Family Resource Center. A covered patio would be adjacent to the community room. The remaining approximately 2,289 sf would be dedicated as a childcare facility, which would include a covered playground. Storage rooms, restrooms, electrical rooms, and a janitor facility would also be included. With respect to outdoor amenities, the proposed project would include a community patio space to the west of the community center. The patio space may include a half-court for basketball and would be mostly hardscape. Behind the community building, in an enclosed area, would be a community patio, an outdoor pool, and a spa. Community open space would be at the center of the complex and would be comprised of mostly lawn and some added trees. Landscaping would be incorporated throughout the project site. The proposed landscaping plan would include large shade trees such as deodar cedar and live oak, medium shade trees such as Chinese Pistache and zelkova, narrow shade trees such as Princeton sentry gingko, and small accent trees such as crape myrtle and Saratoga laurel. Trees planted along B Street would be those recommended for this location by the City. Landscaping selections are intended to be drawn from the lowest water-using category to foster a sustainable landscape. Continuous root barriers would be installed to protect the sidewalk and other flatwork from disruption where necessary. The proposed project would also include frontage improvements along B Street, including curb, gutter, and sidewalk, in addition to construction of sidewalks and bike lanes on the east side of Main Street along the length of the project site frontage, and a bike lane on a portion of the west side of Main Street. The proposed frontage improvements would be installed in accordance with City specifications. Project site access would be provided from B Street through two driveways on the southern frontage of the site, which would provide access to a drive aisle that would surround the proposed residential buildings on the north, east, and west. The drive aisle would provide vehicle access to surface parking areas and the proposed residential buildings. Two secure vehicle gates would be included at both entrances off of B Street. With respect to parking, a total of 142 surface parking spaces would be provided along the perimeter of the project site, including six spots designed in compliance with the Americans with Disabilities Act (ADA). In addition, six stalls would be reserved for electric vehicles (EVs), and 12 stalls would be dedicated to ''clean air'' vehicles as defined by the California Air Resources Board (CARB). The total development cost is projected to be $51,663,697, $191,074 of which would be funded through eight Section 8 PBVs, administered by HUD over a 20-year commitment. FINDING OF NO SIGNIFICANT IMPACT The City of Livingston has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act (NEPA) of 1969 is not required. The Environmental Assessment (EA) and additional project information is contained in the Environmental Review Record (ERR), available on the City of Livingston's website at: https://raney.sharefile.com/public/share/web-sc31d1f045bb04b7598d38c09bf515900 PUBLIC COMMENTS Any individual, group, or agency disagreeing with this determination or wishing to comment on the ERR may submit written comments to Miguel Galvez, City Planner, via email at mgalvez@livingstonca.gov. All comments received by October 2, 2025, will be considered by the City of Livingston prior to authorizing submission of a request for release of funds. Commenters should specify which part of this Notice they are addressing. ENVIRONMENTAL CERTIFICATION The City of Livingston certifies to HUD that Jose A. Ramirez, City Manager for the City of Livingston, in his capacity as Certifying Officer, consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD's approval of the certification satisfies its responsibilities under NEPA and related laws and authorities, and allows the City to use Section 8 PBV funds. OBJECTIONS TO RELEASE OF FUNDS HUD will accept objections to the Responsible Entity's (RE) Request of Release of Funds and Environment Certification for a period of 15 days following the submission date specified above or the actual receipt of the request (whichever is later) only if they are on the following bases: (a) the certification was not executed by the certifying officer of the RE; (b) the RE has omitted a step or fail to make a determination or finding required by HUD regulation at 24 CFR Part 58 or by CEQ regulation 40 CFR 1500-1508, as applicable; (c) the RE has omitted one or more steps in the preparation, completion or publication of the Environmental Assessment or Environmental Impact Statement per 24 CFR subparts E,F or G of Part 58, as applicable; (d) the grant recipient or other participant in the development process has committed funds for undertaken activities not authorized by 24 CFR Part 58 before release of funds and approval of the environmental certification; (e) another Federal, State or local agency has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections to the release of funds must be prepared and submitted in accordance with the required procedures (24 CFR Part 58) and shall be emailed to the HUD grant administration office at alison.M.Brokke@hud.gov. Potential objectors should contact HUD via email at alison.M.Brokke@hud.gov to verify the actual last day of the objection period. Jose A.
