Notice of Sale C/A No: 2025-CP-46-00337 BY VIRTUE OF A DECREE of the Court of Common Pleas for York County, South Carolina, heretofore issued in the case of Bank of America, N.A. vs. Eileen Johnson a/k/a Eileen Carol Johnson, and Tilden Johnson, and if Eileen Johnson a/k/a Eileen Carol Johnson, and Tilden Johnson be deceased then any children and heirs at law to the Estates of Eileen Johnson a/k/a Eileen Carol Johnson, and Tilden Johnson, distributees and devisees at law to the Estates of Eileen Johnson a/k/a Eileen Carol Johnson, and Tilden Johnson, and if any of the same be dead any and all persons entitled to claim under or through them also all other persons unknown claiming any right, title, interest or lien upon the real estate described in the complaint herein; Any unknown adults, any unknown infants or persons under a disability being a class designated as John Doe, and any persons in the military service of the United States of America being a class designated as Richard Roe; Samuel Ira Johnson a/k/a Samuel I Johnson, Individually and as Personal Representative of the Estate of Eileen Johnson a/k/a Eileen Carol Johnson; Sandra Marie Johnson; Carol Ann Leroy, Individually and as Personal Representative of the Estate of Eileen Johnson a/k/a Eileen Carol Johnson; CaroMont Regional Medical Center; Republic Finance, LLC; Onemain Financial, Inc. I the undersigned as Master-in-Equity for York County, will sell on October 6, 2025 at 11:00 AM at Moss Justice Center 1675 York Hwy, York, South Carolina 29745 to the highest bidder: Legal Description and Property Address: ALL THAT certain piece, parcel or lot of land lying and being situate on the eastern side of Hay Row near its intersection with S.C. Highway S. 46-453, in Bethel Township, York County, South Carolina, and being more particularly shown and described as Lot 6, in Block (B), on a subdivision plat of The Olde Farm Place recorded in Plat Book 66, Page 135, in the Office of the Clerk of Court for York County, South Carolina, which plat is by reference incorporated herein as part of this description. THIS BEING the same property conveyed unto Eileen Johnson and Tilden Johnson by virtue of a Deed from Carrie Skinner dated October 28, 2009, and recorded November 3, 2009, in Volume 11101 at Page 111 in the Office of the Clerk of Court for York County, South Carolina. THEREAFTER, Eileen Johnson and Tilden Johnson conveyed a 1% interest in the subject property unto Samuel I. Johnson by virtue of a Deed dated March 22, 2012, and recorded March 6, 2012, in Volume 12479 at Page 33 in the Office of the Clerk of Court for York County, South Carolina. THEREAFTER, Samuel I. Johnson conveyed all of his interest in the subject property unto Eileen Johnson and Tilden Johnson by virtue of a Deed dated October 4, 2014, and recorded October 15, 2014, in Volume 14436 at Page 228 in the Office of the Clerk of Court for York County, South Carolina. THEREAFTER, the subject property was conveyed unto Eileen Johnson from Eileen Johnson as Personal Representative for the Estate of Tilden Johnson (Estate #2023-ES-46-00332) pursuant to the probate of said Estate and by virtue of a Deed of Distribution dated July 19, 2024, and recorded July 19, 2024, in Book RB 21411 at Page 29 in the Office of the Clerk of Court for York County, South Carolina. 1028 Hay Row Road Clover, SC 29710 TMS# 476-00-00-087 TERMS OF SALE: For cash. Interest at the current rate of 5.375% to be paid on balance of bid from date of sale to date of compliance. The purchaser to pay for papers and stamps, and that the successful bidder or bidders, other than the Plaintiff therein, will, upon the acceptance of his or her bid, deposit with the Master-in-Equity for York County a certified check or cash in the amount equal to five percent (5%) of the amount of bid on said premises at the sale as evidence of good faith in bidding, and subject to any resale of said premises under Order of this Court; and in the event the said purchaser or purchasers fail to comply with the terms of sale within Twenty (20) days, the Master-in-Equity for York County shall forthwith resell the said property, after the due notice and advertisement, and shall continue to sell the same each subsequent sales day until a purchaser, who shall comply with the terms of sale, shall be obtained, such sales to be made at the risk of the former purchaser. Since a personal or deficiency judgment is waived, the bidding will not remain open but compliance with the bid may be made immediately. Plaintiff may waive any of its rights prior to sale. Sold subject to taxes and assessments, existing easements and restrictions of record. Neither the Court, nor Plaintiff, nor Plaintiff's counsel makes any warranty of title or representations with regard to the condition or existence of any improvements on the subject property.
