NOTICE OF PUBLIC HEARING
VEHICLE MILES TRAVELED REDUCTION PROGRAM AND NEXUS STUDY, AND RELATED FINAL PROGRAM ENVIRONMENTAL IMPACT REPORT (SCH NO. 2024091129)
NOTICE IS HEREBY GIVEN that the Fresno City Council, in accordance with the procedures of Chapter 15, Sections 5007 and 5801-5812 of the Fresno Municipal Code (FMC) and Government Code 66001, et. Seq., the Mitigation Fee Act, will conduct a public hearing to consider the Vehicle Miles Traveled Reduction Program and Nexus Study and related Final Program Environmental Impact Report (FPEIR), State Clearinghouse (SCH) # 2024091129.
Project Description. The proposed project is the adoption of the Vehicle Miles Traveled (VMT) Reduction Program and Nexus Study, amendment of the Fresno Municipal Code to add a new Section 12-4.17 to establish the VMT Mitigation Fee, and amendment of the Master Fee Schedule to incorporate the Fee. The VMT Reduction Program would apply citywide and within the Fresno Sphere of Influence as growth and development occur.
1. VMT Reduction Program and Nexus Study
a. The VMT Reduction Program includes an Urban Design Calculator and a VMT Mitigation Fee, which can be used in combination or separately, to mitigate project-specific VMT impacts under the California Environmental Quality Act.
b. The Nexus Study includes the required findings for justification of the fee, a Capital Improvement Plan indicating the approximate location, size and cost of the facilities to be financed with the fee, timing of expenditures, and a "Reserve to Complete" account.
2. Fresno Municipal Code Amendment adds Section 12-4.17 to establish the VMT Mitigation Fee
3. Master Fee Schedule Amendment incorporates the Fee into the Master Fee Schedule
4. Program Environmental Impact Report Sch No. 2024091129: In accordance with the California Environmental Quality Act (CEQA), a Program Environmental Impact Report (PEIR) was prepared by the City to consider potential impacts associated with implementation of the project, and to provide mitigation measures that would reduce impacts to less than significant levels. The Draft PEIR was released for a 45-day public review period from July 2, 2025 to August 15, 2025.

Any interested person may appear at the public hearing and present written testimony or speak in favor or against the project proposal. However, all documents submitted to the City Council for its consideration should be submitted according to the instructions provided in the agenda at least 24 hours prior to the start of the Council Agenda item being heard, pursuant to the City Council's meeting rules and procedures. If an individual challenges the above applications in court, they may be limited to raising only those issues that were raised at the public hearings described in this notice, or in written correspondence delivered to the City Council.
