IN THE CHANCERY COURT OF HARRISON COUNTY, MISSISSIPPI SECOND JUDICIAL DISTRICT MICHAEL WALSH PLAINTIFF VS. CAUSE NO. 24-910(JP) CHARLAMAYNE WALSH DEFENDANT SUMMONS BY PUBLICATION THE STATE OF MISSISSIPPI TO: CHARLAMAYNE WALSH Wherever she may be found You have been made a Defendant in the suit filed in this Court by Michael Walsh seeking a divorce from you. There are no other Defendants named in this action. As stated in the Complaint, Plaintiff is an adult resident citizen of Harrison County, Mississippi, and has been a resident of the State of Mississippi for more than six (6) months next preceding the commencement of this action. Upon information and belief, Defendant is an adult resident citizen of Hancock County, Mississippi and has been for more than six (6) months or at least he was at the time she departed the marital home in 2023. Plaintiff is a member of the Caucasian race; Defendant is a member of the Caucasian race. Plaintiff and Defendant were married to each other on or about May 16, 2022 in the State of Mississippi. The parties no longer reside together, have no children together and no property together and the Defendant left the marital home on January 2, 2023 and has not returned. The Court has jurisdiction over the parties and subject matter herein. Venue is proper before this Court. That at all times during the marriage the Plaintiff did all within his power to make the marriage a happy and successful one. However, despite his efforts the Defendant has acted and continues to act so that it would be impossible for the Plaintiff to continue his efforts in this marriage. The Plaintiff is entitled to a divorce on the grounds of habitual cruel and inhuman treatment as there exists a continuous course of conduct on the part of the Defendant which is so unkind, unfeeling and or brutal as to endanger, or put one in reasonable apprehension of danger to life, limb or health, and further, such conduct is it habitual, that is, it is done often enough for so continuously that it may be reasonably said to be a permanent condition. The Defendant has willfully and intentionally neglected her husband and her affections for her husband. The Plaintiff is prepared to offer evidence of this fault-based ground for divorce at the trial of this matter. The Defendant has engaged in the willful, continued, intentional, obstinate and uninterrupted desertion of the marriage for the space of more than one (1) year. In fact, the wife departed the marital home in 2023. The wife has not returned to the marital home since 2023 and has broken off communication with husband. The husband would have accepted the wife back into the marital home within the first year of the desertion, but she did not return. There are no offspring of the union and there is no real property, personal property, assets or debts that need to be distributed by the Court. In the alternative, Plaintiff is entitled to a divorce for irreconcilable differences pursuant to Section 93-5-2 of the Mississippi Code Annotated (1972). There were no children born of the marriage. The wife is not currently pregnant. You are required to mail or hand deliver a written response to the Complaint filed against you in this action to Attorney Jeffrey G.
