NOTICE OF SALE UNDER POWER STATE OF GEORGIA COUNTY OF BIBB Under and by virtue of the power of sale contained in that certain Deed to Secure Debt from Bryon Lawrence Cummings (the "Grantor") to AgGeorgia Farm Credit ACA, for itself and as agent/nominee (the "Lender"), dated May 17, 2021, a copy of which is of record in Deed Book 10886, Pages 253-259, Clerk's Office, Bibb County Superior Court (the "Security Deed"), said Security Deed having been given to secure that certain promissory note of even date therewith executed by Grantor in favor of Lender in the original principal amount of One Hundred Fifty-Nine Thousand Six Hundred and 00/100 Dollars ($159,600.00), together with interest thereon as set forth therein and together with any and all renewals, reamortizatons, extensions, refinances, modifications, or other rearrangements thereof and all other indebtedness and obligations of said Grantor to Lender (collectively, the "Note"), there will be sold at public outcry to the highest bidder for cash at the United Building in Central City Park (a/k/a Carolyn Crayton Park) located at 206 7th Street, Macon, Georgia 31201, within the legal hours of sale on the first Tuesday of October, 2025, to-wit: October 7, 2025, the following described real property (the "Property"), together with all trees, timber, shrubbery, fixtures and improvements located thereon and all rights, members and appurtenances thereunto belonging or in anywise appertaining and otherwise as may be set forth in the Security Deed: All that tract or parcel of land lying and being in Land Lots 222, 227, and 228 of the 3rd Land District, Macon-Bibb County, Georgia, being known and designated as Remainder of Parcel "Y", containing 140.85 acres, more or less, as shown on a plat of a compiled plat for JFS Properties, Inc. made by Brent Cunningham, Georgia Registered Surveyor, dated August 14, 1996 and revised August 23, 1996 and recorded in Deed Book 3058, Page 150, Clerk's Office, Bibb Superior Court, which plat by this reference thereto is incorporated herein for a more complete and accurate description of said property. LESS AND EXCEPT All those tracts or parcels of land lying and being in Land Lots 227 and 228 of the 3rd Land District, Macon-Bibb County, Georgia, being known and designated as Lots 102, 103, 104, 105, 106, 107, 108, 109, 110, 111, 112, 113, 114, 115, 116, 117 and 118, Wood Creek Estates, Phase One, as shown on a plat of a subdivision survey of Part of Wood Creek Estates, Phase One, made by Jesse Collins, Jr., Georgia Registered Land Surveyor Number 2085, dated May, 1997 and recorded in Plat Book 88, Pages 890 and 891, Clerk's Office, Bibb Superior Coutt, which plat by this reference thereto is incorporated herein for a more complete and accurate description of said property. LESS AND EXCEPT All those tracts or parcels of land lying and being in Land Lot 228 of the 3rd Land District, Macon-Bibb County, Georgia, being known and designated as Lots 100, 101, 119, 120 and 121, Wood Creek Estates, Phase One, as shown on a plat of a subdivision survey of Part of Wood Creek Estates, Phase One, made by Ronald Heald, Jr., Georgia Registered Surveyor, dated February, 1997 and recorded in Plat Book 88, Page 773, Clerk's Office, Bibb Superior Court, which plat by this reference thereto is incorporated herein for a more complete and accurate description of said property. ALSO LESS AND EXCEPT, all that tract of parcel of land lying and being in Land Lots 222 and 227, 3rd Land District, Bibb County, Georgia, being shown as Tract 1, 5.00 Acres, on a plat of survey by Wellston Associates Land Surveyors, LLC dated June 6, 2022, entitled "Subdivision Survey Lands of Bryon Cummings" recorded in Plat Book 95, Page 20, Clerk's Office, Bibb Superior Court. Said plat is incorporated herein for a more complete and accurate description of the property conveyed. The debt secured by the Security Deed has been and is hereby declared due because of, among other possible events of default, the failure to pay the indebtedness as and when due and in the manner provided in the Note. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, including attorney's fees. The Property will be sold as the property of Bryon Lawrence Cummings, subject to all zoning ordinances; matters which would be disclosed by an accurate survey or by an inspection of the Property; any outstanding taxes, including but not limited to, ad valorem taxes, which constitute liens upon the Property; special assessments; all outstanding bills for public utilities which constitute liens upon the Property; and all matters of record superior to said Security Deed. This sale will be conducted subject to (1) confirmation that the sale is not prohibited under the U.S. Bankruptcy Code, (2) the provisions of O.C.G.A. Section 9-13-172.1 which permits the rescission of judicial and nonjudicial sales in the State of Georgia in limited circumstances, and (3) final confirmation and audit of the status of the loans with the holder of the Security Deed. Notice has been given of intention to collect attorney's fees in accordance with the terms of the Note secured by said Security Deed. Notice has also been given, in writing and by certified mail, return receipt requested, to Grantor, of the name, address, and telephone number of the individual or entity who shall have full authority to negotiate, amend, and modify all terms of the Security Deed and the Note thereby secured in accordance with O.C.G.A. Section 44-14-162.2(a). To the best knowledge and belief of the undersigned, the party in possession of the Property is Bryon Lawrence Cummings, or tenant or tenants, and the proceeds of said sale will be applied to the payment of said indebtedness and the expenses of said sale.
