CITY OF HIALEAH PUBLIC HEARING SEPTEMBER 23, 2025 THE HIALEAH CITY COUNCIL AT ITS REGULARLY SCHEDULED MEETING OF SEPTEMBER 9, 2025 APPROVED THE FOLLOWING PROPOSED ORDINANCES ON FIRST READING. SECOND READING AND PUBLIC HEARING FOR FINAL ADOPTION WILL BE HELD ON SEPTEMBER 23, 2025. ALL INTERESTED PARTIES ARE INVITED TO PARTICIPATE. THE MEETING WILL BEGIN AT 5:30 P.M. THE PROPOSED ORDINANCES WILL BE AVAILABLE FOR INSPECTION AND COPYING AT THE OFFICE OF THE CITY CLERK, 3rd FLOOR, 501 PALM AVENUE, HIALEAH, FL., FROM 8:30 A.M. TO 5:00 P.M. (Note: Due to the Miami Herald's deadline, ordinances that are tabled, denied or withdrawn will appear in this advertisement). ORDINANCE OF THE MAYOR AND THE CITY COUNCIL OF THE CITY OF HIALEAH, FLORIDA, APPROVING THE LEASE AGREEMENT BETWEEN THE CITY OF HIALEAH AND CITY OF HIALEAH EDUCATION ACADEMY, INC. ("COHEA") FOR LAND OWNED AND OPERATED BY THE CITY OF HIALEAH, LOCATED AT 2590 WEST 76 STREET, HIALEAH, FLORIDA, FOR A PERIOD NOT TO EXCEED FIFTY (50) YEARS, TOGETHER WITH SUCH RIGHTS AND DUTIES AS MORE FULLY DESCRIBED IN THE LEASE AGREEMENT, A COPY OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF AS EXHIBIT "A"; AUTHORIZING THE MAYOR AND THE CITY CLERK, AS ATTESTING WITNESS, ON BEHALF OF THE CITY, TO ENTER INTO THE LEASE AGREEMENT; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; PROVIDING PENAL TIES FOR VIOLATION HEREOF; PROVIDING FOR A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. ORDINANCE OF THE MAYOR AND THE CITY COUNCIL OF THE CITY OF HIALEAH, FLORIDA, AMENDING CHAPTER 30, ENTITLED "ELECTED OFFICIALS" ARTICLE II – PUBLIC MEETINGS, §30-31 (A) SPECIFICALLY REPLACING 96 HOURS TO 120 HOURS FOR DISTRIBUTION OF THE AGENDA TO CITY COUNCIL MEMBERS PRIOR TO THE MEETING; REPEALING ALL ORDINCES OR PARTS OF ORDINANCES IN CONFLICTHEREWITH; PROVIDING FOR PENALTIES FOR VIOLATION HEREOF; PROVIDING FOR A SEVERABILITY CLAUDE; PROVIDING FOR INCLUSION IN THE CODE; AND PROVIDING FOR AN EFFECTIVE DATE. ORDINANCE OF THE MAYOR AND THE CITY COUNCIL OF THE CITY OF HIALEAH, FLORIDA, AMENDING THE FUTURE LAND USE MAP FROM MEDIUM-DENSITY RESIDENTIAL TO HIGH-DENSITY RESIDENTIAL; PROPERTY LOCATED AT 541 EAST 22 STREET, HIALEAH, ZONED R-1 (ONE FAMILY DISTRICT) AND LEGALLY DESCRIBED HEREIN; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; PROVIDING PENALTIES FOR VIOLATION HEREOF; PROVIDING FOR A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. ORDINANCE OF THE MAYOR AND THE CITY COUNCIL OF THE CITY OF HIALEAH, FLORIDA, REZONING PROPERTY FROM R-3-3 (MULTIPLE-FAMILY DISTRICT) TO R-3-5 (MULTIPLE-FAMILY DISTRICT); GRANTING A VARIANCE PERMIT TO ALLOW A LOT COVERAGE OF 48.19%, WHERE 30% IS THE MAXIMUM LOT COVERAGE ALLOWED; ALLOW AN INTERIOR WEST SIDE SETBACK OF 7.2 FEET, WHERE 10 FEET ARE REQUIRED; ALLOW AN INTERIOR EAST SIDE SETBACK OF 4.2 FEET, WHERE 10 FEET ARE REQUIRED; ALLOW A REAR SETBACK OF 14 FEET, WHERE 20 FEET ARE REQUIRED; ALLOW 8 PARKING SPACES, WHERE 10 PARKING SPACES ARE REQUIRED; ALLOW 23.30% PERVIOUS AREA, WHERE 30% IS THE MINIMUM REQUIRED; AND ALLOW PROPOSED DUMPSTER ENCLOSURE TO BE 3.7 FEET FROM THE RIGHT-OF-WAY FRONTING EAST 22 STREET, WHERE 10 FEET IS THE MINIMUM REQUIRED, ALL IN CONTRAST TO HIALEAH CODE OF ORDINANCES §98-590; 98-591; 98-2189 (19)b, §78-108(c)(1), AND SECTION "E" OF THE HIALEAH LANDSCAPE MANUAL, UPDATED JULY, 2025, ENTITLED "TREE AND LAWN REQUIREMENTS BY ZONING CLASSIFICATION", UPDATED JULY, 2025. PROPERTY LOCATED AT 541 EAST 22 STREET, HIALEAH, ZONED R-3-3 (MULTIPLE-FAMILY DISTRICT), AND LEGALLY DESCRIBED HEREIN; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; PROVIDING PENALTIES FOR VIOLATION HEREOF; PROVIDING FOR A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. PROPERTY LOCATED AT 2315 WEST 4 AVENUE, HIALEAH, ZONED M-3 (INDUSTRIAL DISTRICT) AND LEGALLY DESCRIBED HEREIN; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; PROVIDING PENALTIES FOR VIOLATION HEREOF; PROVIDING FOR A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. ORDINANCE OF THE MAYOR AND THE CITY COUNCIL OF THE CITY OF HIALEAH, FLORIDA, GRANTING A SPECIAL USE PERMIT (SUP) TO ALLOW AN ELEMENTARY SCHOOL TO OPERATE ON PROPERTY ZONED R-1 (ONE-FAMILY DISTRICT); GRANTING A CONDITIONAL USE PERMIT (CUP) PURSUANT TO THE CITY OF HIALEAH CODE OF ORDINANCES §98-181 TO ALLOW A K-5 GRADE ELEMENTARY SCHOOL, ON A FREESTANDING CAMPUS SETTING PROPERTY, WITH A MAXIMUM CAPACITY OF 71 STUDENTS IN CONJUNCTION WITH A DAYCARE WITH A CAPACITY OF 169 CHILDREN; AND GRANTING A VARIANCE PERMIT TO ALLOW AN 8-FOOT HEIGHT WALL, WHERE 6-FOOT HEIGHT WALL IS THE MAXIMUM ALLOWED ON RESIDENTIAL ZONED PROPERTIES; ALL IN CONTRAST TO SECTION "D(6)" OF THE HIALEAH LANDSCAPE MANUAL, UPDATED JULY, 2025, ENTITLED "SHRUBS, VINES, GROUND COVERS, MULCH, BUFFERS, PLANT QUALITY, STORM WATER RETENTION + DETENTION AREAS, NATIVE SPECIES AND LANDSCAPE MITIGATION." PROPERTY LOCATED AT 21 EAST 59 STREET, HIALEAH, ZONED R-1 (ONE-FAMILY DISTRICT) AND LEGALLY DESCRIBED HEREIN; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; PROVIDING PENALTIES FOR VIOLATION HEREOF; PROVIDING FOR A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE.
