NOTICE OF FORECLOSURE SALE UNDER POWER
BIBB COUNTY, GEORGIA
Under and by virtue of the Power of Sale contained in that certain Security Deed from Aaron Burks to NCBW Atlanta LLC, dated April 14, 2023, recorded in Deed Book 11548, page 373-378, Bibb County, Georgia records, said Security Deed being given to secure a Promissory Note dated April 14, 2023, in the original principal amount of $19,900, with interest thereon as set forth therein, there will be sold at public outcry to the highest bidder for cash at United Building in Central City Park, 206 7th St. Macon, GA, within the legal hours of sale the first Tuesday of October, 2025, the following described property:
All that tract or parcel of land lying and being in the City of Macon, Bibb County, Georgia, and being known as Park of Lot S of the Berkner Property and Part of Lot 10, Block F of Windmere; a plat of the Berkner Property being of record in Plat Book 5, Folio 52, and a Plat of Windmere being of record in Plat Book 8, Folio 86, Clerk's Office, Bibb Superior Court, Bibb County, Georgia. Said plat is by reference thereto made a part hereof for the purpose of a more accurate and complete description. This is the same property conveyed by deed to Brenda Foster Pope from Barbara Foster Hill and Louis Foster, Jr. dated September 2, 2009, recorded in Deed Book 11548, page 373, Superior Court Clerk's Office, Bibb County, Georgia deed records. Tax Map/Parcel ID No. 0081-0101. To the best knowledge and belief of the undersigned, the party in possession of the property is Aaron Burks, successors or tenants(s); and said property is more commonly known as: 1511 Berkner Ave. Macon, GA 31204.
The debt secured by said Security Deed has been and is hereby declared due because of, among several events of default, the failure to make payments as required by the terms of the Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, plus accrued interest, attorney's fees with notice of intent to collect attorney's fees given, late fees, and all charges permissible under law, the Note and Security Deed. Because of said default, the Power of Sale is invoked and the said property will be sold, subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.
The sale will be conducted subject to (1) confirmation that the sale is not prohibited under the U.S. Bankruptcy Code, and (2) final confirmation and audit of the status of the loan with the Security Deed holder, and (3) any right of redemption or other lien not extinguished by foreclosure. Said property will be sold on an "as-is, where-is" basis without any representation, warranty or recourse against the above-named creditor or the undersigned.
