NOTICE OF SALE UNDER POWER
STATE OF GEORGIA
COUNTY OF MUSCOGEE
Under and by virtue of the power of sale contained in that certain deed to secure debt from Touch by An Angel City Homes Inc., (the "Grantor") to Income Property Investors, Inc., (the "Lender"), dated September 20, 2024, and recorded in Deed Book 14520, Page 220, Clerk's Office, Muscogee County Superior Court, (said deed to secure debt is hereinafter referred to as the "Security Deed), said Security Deed having been given to secure that certain promissory note dated the same, executed by Grantor in favor of Income Property Investors, Inc., in the original principal amount of Twelve Thousand Five Hundred and 0/100 Dollars ($12,500.00), together with interest thereon as set forth therein and together with all extensions or renewals thereof and all other indebtedness or obligations of Grantor to Lender (the "Note"), there will be a sale at public outcry to the highest bidder for cash before the Courthouse door (as directed by the Superior Court of Muscogee County) of Muscogee County, Georgia, within the legal hours of sale on the first Tuesday of October, 2025,(to-wit: October 7, 2025), the following described real property (the "Property"), together with all fixtures and improvements located thereon and all rights, members and appurtenances thereunto belonging or in anywise appertaining:
Tract 1: 808 Fulton Ave.
All that tract or parcel of land lying and being in Land Lot 78 of the Coweta Reserve District of Muscogee County, Georgia and being known and designated as Lot 6, Block C, Stathmore Park Subdivision, according to a plat of record in Plat Book 73, Page 468, Clerk's Office, Muscogee Superior Court. Said plat and the recorded copy thereof are hereby made a part of this description by reference thereto.
There are improvements located on said property known under the present system of numbering as 808 Fulton Avenue, Columbus, Georgia.
This is the same property conveyed to Georgette Trujillo Reyes, by deed dated July 10, 2023, and of record in Deed Book 14187, Page 82, said Clerk's Office.

The debt secured by the Security Deed has been and is hereby declared due because of, among other possible events of default, the failure to pay the indebtedness as and when due and in the manner provided in the Note. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, including attorney's fees.
The Property will be sold as the property of Touch by An Angel City Homes Inc., subject to all zoning ordinances; matters which would be disclosed by an accurate survey or by an inspection of the Property; any outstanding taxes, including but not limited to ad valorem taxes which constitute liens upon said Property; special assessments; all outstanding bills for public utilities which constitute liens upon said Property; and all matters of record superior to said Security Deed, including, but not limited to, any Federal tax liens.
This sale will be conducted subject to (1) confirmation that the sale is not prohibited under the U.S. Bankruptcy Code, (2) the provisions of O.C.G.A. Section 9-13-172.1 which permits the rescission of judicial and nonjudicial sales in the State of Georgia in limited circumstances, (3) final confirmation and audit of the status of the loans with the holder of the Security Deed and (4) Security Deed in favor of Georgette Reyes dated September 20, 2024, recorded in Deed Book 14520, Page 208, Clerk's Office, Muscogee Superior Court.
Notice has been given of intention to collect attorney's fees in accordance with the terms of the Note secured by said Security Deed. Notice has also been given, in writing and by certified mail, return receipt requested, to Grantor, of the name, address, and telephone number of the individual or entity who shall have full authority to negotiate, amend, and modify all terms of the Security Deed and the Note thereby secured in accordance with O.C.G.A. Section 44-14-162.2(a).
To the best knowledge and belief of the undersigned, the parties in possession of the Property are Touch by an Angel City Homes Inc., or tenant or tenants, and the proceeds of said sale will be applied to the payment of said indebtedness and the expenses of said sale.
PLEASE BE ADVISED THAT THIS LAW FIRM IS ACTING AS A DEBT COLLECTOR ATTEMPTING TO COLLECT A DEBT. ANY INFORMATION OBTAINED WILL BE USED FOR THAT PURPOSE.
