NOTICE OF SALE UNDER POWER STATE OF GEORGIA COUNTY OF BIBB Under and by virtue of the power of sale contained in that certain deed to secure debt from Kory Solomon (the "Grantor") to Next Generation Lending II, LLC (the "Lender"), dated April 3, 2025, and recorded in Deed Book 12119, Page 63, Clerk's Office, Bibb County Superior Court, (said deed to secure debt is hereinafter referred to as the "Security Deed), said Security Deed having been given to secure that certain promissory note dated April 3, 2025, executed by Grantor in favor of Next Generation Lending II, LLC, in the original principal amount of Forty Eight Thousand Seven Hundred and Seven Dollars and 50/100 cents ($48,707.50), together with interest thereon as set forth therein and together with all extensions or renewals thereof and all other indebtedness or obligations of Grantor to Lender (the "Note"), there will be a sale at public outcry to the highest bidder for cash before the Courthouse door (as directed by the Superior Court of Bibb County) of Bibb County, within the legal hours of sale on the first Tuesday of October, 2025,(to-wit: October 7, 2025), the following described real property (the "Property"), together with all fixtures and improvements located thereon and all rights, members and appurtenances thereunto belonging or in anywise appertaining: Tract 1: 2868 Barrett Avenue All that tract or parcel of land lying and being in the 4th Land District, Macon-Bibb County, Georgia, being known and designated as Lot 8, Block B, Bloomfield Estates, according to a plat recorded in Plat Book 22, Page 126, Clerk's Office, Bibb Superior Court. Said plat is incorporated herein for this purpose of a more complete and accurate description of the metes, bounds and dimensions of said property. This is the same property conveyed to Kory Solomon by deed June 13, 2024 and recorded in Deed Book 11878, Page 151, Clerk's Office, Bibb Superior Court. This is a dwelling located thereon known under the present system of numbering as 2868 Barrett Avenue, Macon, Georgia 31206 Tax/Map Parcel Number L102-0305 The debt secured by the Security Deed has been and is hereby declared due because of, among other possible events of default, the failure to pay the indebtedness as and when due and in the manner provided in the Note. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, including attorney's fees. The Property will be sold as the property of Kory Solomon, subject to all zoning ordinances; matters which would be disclosed by an accurate survey or by an inspection of the Property; any outstanding taxes, including but not limited to ad valorem taxes which constitute liens upon said Property; special assessments; all outstanding bills for public utilities which constitute liens upon said Property; and all matters of record superior to said Security Deed, including, but not limited to, any Federal tax liens. This sale will be conducted subject to (1) confirmation that the sale is not prohibited under the U.S. Bankruptcy Code, (2) the provisions of O.C.G.A. Section 9-13-172.1 which permits the rescission of judicial and nonjudicial sales in the State of Georgia in limited circumstances, and (3) final confirmation and audit of the status of the loans with the holder of the Security Deed. Notice has been given of intention to collect attorney's fees in accordance with the terms of the Note secured by said Security Deed. Notice has also been given, in writing and by certified mail, return receipt requested, to Grantor, of the name, address, and telephone number of the individual or entity who shall have full authority to negotiate, amend, and modify all terms of the Security Deed and the Note thereby secured in accordance with O.C.G.A. Section 44-14-162.2(a). To the best knowledge and belief of the undersigned, the parties in possession of the Property are Kory Solomon, or tenant or tenants, and the proceeds of said sale will be applied to the payment of said indebtedness and the expenses of said sale.
