STATE OF GEORGIA COUNTY OF MUSCOGEE NOTICE OF SALE UNDER POWER Pursuant to the power of sale contained in the Security Deed executed by THEODORE JOSEPH SZUTOWICZ, II to MORTGAGE ELECTRONIC REGISTRATION SYSTEMS, INC., AS BENEFICIARY, AS NOMINEE FOR TAYLOR, BEAN & WHITAKER MORTGAGE CORP. in the original principal amount of $94,400.00 dated June 21, 2004, and recorded in Deed Book 7475, Page 296, Muscogee County records, said Security Deed being last transferred to U.S. BANK NATIONAL ASSOCIATION, AS TRUSTEE, FOR CSFB MORTGAGE BACKED PASS-THROUGH CERTIFICATES, SERIES 2004-5 in Deed Book 14724, Page 381, Muscogee County records, the undersigned will sell at public outcry to the highest bidder for cash, before the Courthouse door in said County, or at such other place as lawfully designated, within the legal hours of sale, on October 7, 2025, the property in said Security Deed and described as follows: ALL THAT LOT, TRACT OR PARCEL OF LAND SITUATE, LYING AND BEING IN THE STATE OF GEORGIA, COUNTY OF MUSCOGEE AND CITY OF COLUMBUS, AND BEING KNOWN AND DESIGNATED AS ALL OF LOT NUMBERED NINETEEN (19), IN BLOCK "49", PARK PLACE, AS SAID LOT IS SHOWN UPON A MAP OR PLAT ENTITLED "LOT 19, BLOCK 49, PARK PLACE, LYING IN LAND LOT 74, COWETA RESERVE, COLUMBUS, MUSCOGEE COUNTY, GEORGIA", PREPARED BY MOON, MEEKS & PATRICK, INC., DATED MARCH 25, 1986, AND BEING RECORDED IN PLAT BOOK 96, FOLIO 94, OF THE RECORDS IN THE OFFICE OF THE CLERK OF THE SUPERIOR COURT OF MUSCOGEE COUNTY, GEORGIA, TO WHICH REFERENCE IS MADE FOR THE SPECIFIC DIMENSIONS AND LOCATION OF SAID LOT. THIS PROPERTY HAS A STREET OR MAILING ADDRESS CURRENTLY ASSIGNED BY GOVERNMENTAL AUTHORITY OF 1913 - 18TH AVENUE, COLUMBUS, GEORGIA. Said property being known as: 1913 18TH AVE, COLUMBUS, GA 31901 To the best of the undersigned's knowledge, the party or parties in possession of said property is/are THEODORE JOSEPH SZUTOWICZ, II or tenant(s). The debt secured by said Security Deed has been and is hereby declared due and payable because of, among other possible events of default, failure to pay the indebtedness as provided for in the Note and said Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of sale, including attorney's fees (notice of intent to collect attorney's fees having been given). Said property will be sold subject to the following: (1) any outstanding ad valorem taxes (including taxes which are a lien, whether or not yet due and payable); (2) the right of redemption of any taxing authority; (3) any matters which might be disclosed by an accurate survey and inspection of the property; and (4) any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.
