LEGAL NOTICE NOTICE IS HEREBY GIVEN THAT ON WEDNESDAY, SEPTEMBER 10TH, 2025, AT 6:00 P.M., THE CITY OF HIALEAH PLANNING AND ZONING BOARD WILL HOLD A PUBLIC HEARING IN THE COUNCIL CHAMBERS OF CITY HALL, 3RD FLOOR, 501 PALM AVENUE. THE PLANNING AND ZONING BOARD WILL CONSIDER THE FOLLOWING REQUESTS: Final decision to allow rear setback of 12.5 feet, where 20 feet are required for the legalization of an existing 255 square feet aluminum roof terrace, and to allow interior south side setback of 2 feet, where 7.5 feet are required for an existing 226 square feet aluminum roof. Property is located at 5364 West 14th Court, Hialeah, zoned R-1 (One-family District). ALL RECOMMENDATIONS MADE AT THIS MEETING WILL BE PRESENTED FOR HEARING TO THE CITY COUNCIL AT ITS MEETING OF TUESDAY, OCTOBER 14TH, 2025. Rezoning property from R-3 (Multiple-Family District) to R-3-3 (Multiple-Family District). Variance permit to allow a living unit where parking spaces are provide; allow an existing structure with the following setbacks: rear setback of 6.91 feet, where 20 feet are required; interior east side setback of 2.1 feet, where 10 feet are required; interior west side setback of 1.2 feet, where 10 feet are required; allow a proposed three-story structure with the following setbacks: front setback of 17.41 feet, where 25 feet are required; interior east side setback of 2.66 feet, where 10 feet are required; interior west side setback of 5 feet, where 10 feet are required; allow a total lot coverage of 46.80%, where 30% is the maximum lot coverage allowed, and to allow 6 parking spaces, where 7 parking spaces are required. Variance permit to allow the expansion of an existing non-conforming 256 square feet manual carwash business granted by Ordinance 90-139 issuing a Special Use Permit (SUP) to allow said use on property zoned B-1 (Highly Restricted Retail District), where manual carwash use has never been an allowed use in the B-1 zoning classification; where manual carwash is not a permitted use under Sec. 98-1987; where non-conforming manual carwashes are only allowed on properties zoned C-1 (Restricted Retail Commercial District) and C-2 (Liberal Retail Commercial District); and where a Declaration of Restrictive Covenants has been proffered in 1990 stating that the manual carwash would comply with Sections A through G of Ordinance 89-81. The proposed expansion includes the construction of an additional 460 square feet structure replacing an existing 460 square feet metal roof built without the benefit of a building permit and in violation of the 1990 proffered Declaration of Restrictive Covenants and that is inconsistent with current building code requirements. Variance permit to allow 104 parking spaces, where the existing shopping center was approved with 106 parking spaces, and where 115 parking spaces are required and variance permit to allow landscape mitigation of 15 canopy trees, where only 4 canopy trees currently exist at the site that was originally approved with 20 canopy trees. Property is located at 5350 West 12th Avenue, Hialeah, zoned B-1 (Highly Restricted Retail District). Conditional Use Permit (CUP) to allow a Kindergarten class with a maximum capacity of 9 students in conjunction with a 42-children daycare. Variance permit to allow 3 parking spaces fronting East 20th Street and 1 parking space fronting East 4th Avenue to back out into the right-of-way, where back-out parking is only allowed in low-density residential properties; allow a 21-foot accessway to perpendicular parking spaces, where 22 feet are required, and allow 7% pervious area, where 18% is the minimum pervious area required. Property is located at 2019 East 4th Avenue, Hialeah, zoned B-1 (Highly-Restricted Retail District). Special Use Permit (SUP) to allow a clinical research center conducting clinical trials to test new drugs, devices, and other forms of treatment. Property is located at 3750 West 16th Avenue, Suite 236U, Hialeah, zoned M-1 (Industrial District). ORDINANCE OF THE MAYOR AND THE CITY COUNCIL OF THE CITY OF HIALEAH AMENDING CHAPTER 98, § 98-2200 OF THE CODE OF ORDINANCES OF THE CITY OF HIALEAH ENTITLED "PARKING COMMERCIAL VEHICLES, RECREATIONAL VEHICLES, BOATS OR VESSELS ON PROPERTY ZONED RESIDENTIAL"; SPECIFICALLY CLARIFYING THAT A 60-DAY WARNING SHALL APPLY TO RECREATIONAL VEHICLES ONLY UNDER SUBPARAGRAPH (G) AND NOT TO VEHICLES GENERALLY DESCRIBED IN THE ENTIRE SECTION; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; PROVIDING PENALTIES FOR VIOLATION HEREOF; PROVIDING FOR A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. ALL RECOMMENDATIONS MADE AT THIS MEETING WILL BE PRESENTED FOR HEARING TO THE CITY COUNCIL AT ITS MEETING OF TUESDAY, SEPTEMBER 23RD, 2025.
