NOTICE OF SALE NOTICE OF SALE CIVIL ACTION NO. 2019-CP-46-01407 BY VIRTUE of the decree heretofore granted in the case of: Wells Fargo Bank, N.A. vs. Lora Ann Byers; Derrick Bernard Bogan; Laurel Creek Homeowners Association, Inc.; Mortgage Electronic Registration Systems, Inc.; Andrews Federal Credit Union; Founders Federal Credit Union; GEORGE W CHRISTOPHER, the undersigned Master In Equity for York County, South Carolina, will sell on September 8, 2025 at 11:00 AM, or on another date, thereafter as approved by the Court, at the Moss Justice Center, 1675 York Highway, Courtroom C, City of York, State of South Carolina, to the highest bidder: All that certain piece, parcel or lot of land lying, being and situate in the City of Rock Hill, County of York, State of South Carolina, and being shown and designated as Lot 8 of the Village of Marley at Laurel Creek and containing 0.50 acres upon plat entitled "The Village of Marley at Laurel Creek" prepared by James T. Poore, Surveyor, dated June 29, 2000 and recorded in Plat Book B-254, Page 7 in the Office of the Clerk of Court for York County, SC, which plat is incorporated herein by reference, and having such metes, bounds, courses and distances as by reference to said plat will more fully appear. This being the same property conveyed Lora Ann Byers by Deed of Shephard K. Tate and Blair J. Tate dated September 28, 2016, and recorded October 6, 2016, in Book 15978, Page 216 in the Records for York County, South Carolina. Thereafter, Lora Ann Byers conveyed her entire interest to Lora Ann Byers and Derrick Bernard Bogan as joint tenants with right of survivorship by Quit Claim Deed dated June 15, 2017, and recorded June 16, 2017, in Book 16431, Page 379 in said Records. CURRENT ADDRESS OF PROPERTY: 4177 Marley Court, Rock Hill, SC 29732 TMS: 635-04-01-079 TERMS OF SALE: The successful bidder, other than the Plaintiff, will deposit with the Master In Equity, at conclusion of the bidding, five percent (5%) of his bid, in cash or equivalent, as evidence of good faith, balance due within 20 days. The deposit will be applied to the purchase price in case of compliance, but in the case of non-compliance to be forfeited and first applied to the costs incurred by the Plaintiff related to the sale and the balance then applied to the Plaintiff's debt in a manner suitable to the Plaintiff. Should the last and highest bidder fail to comply with the terms of the bid, then the Master In Equity may re-sell the property on the same terms and conditions on the same or some subsequent Sales Day. Deficiency judgment being demanded, the bidding will not be closed on the day of sale but will remain open for a period of thirty (30) days as provided by law. Plaintiff is demanding a deficiency. The Plaintiff may waive any of its rights, including its right to a deficiency judgment, prior to sale. Purchaser to pay for documentary stamps on the Deed. The sale shall be subject to taxes and assessments, existing easements and restrictions, easements and restrictions of record and any other senior encumbrances.
