NOTICE OF SALE NOTICE OF SALE CIVIL ACTION NO. 2025-CP-46-00875 BY VIRTUE of the decree heretofore granted in the case of: loanDepot.com, LLC vs. Any heirs-at-law or devisees of Terry Catoe a/k/a Terry Lee Catoe, deceased, their heirs, Personal Representatives, Administrators, Successors and Assigns, and all other persons or entities entitled to claim through them; all unknown persons or entities with any right, title, estate, interest in or lien upon the real estate described in the complaint herein; also any persons who may be in the military service of the United States of America, being a class designated as Richard Roe; and any unknown minors, incompetent or imprisoned person, or persons under a disability being a class designated as John Doe; Catherine Newton; MV Realty of South Carolina, LLC, the undersigned Master In Equity for York County, South Carolina, will sell on September 8, 2025 at 11:00 AM, or on another date, thereafter as approved by the Court, at the Master in Equity's Office, Moss Justice Center, 1675 York Highway, York, South Carolina, to the highest bidder: All that certain piece, parcel or lot of land lying, being and situate in the State of South Carolina, County of York, containing 0.60 acre, more or less, and being designated as Lots 23, 24 and 25 in Block 10 on plat of Section 1, Lakewood Subdivision, and according to a survey thereof prepared by J.B. Fisher, SCRLS, dated April 24, 1990, recorded in Plat Book 94, page 906, to which said plat is incorporated herein by this reference and having such metes, bounds, courses and distances as by this reference to said plat will more fully appear. The within property is conveyed subject to all existing easements and restrictions appearing in the chain of title, which said easements and restrictions are not intended to be reimposed hereby. This being the same property as conveyed to Terry Catoe and Wanda Catoe, as joint tenants with right of survivorship, by Deed of R.E. Hammons dated March 21, 2013 and recorded March 25, 2013 in Book 13297 at Page 223 and by Corrective Deed, to correct the legal description, dated October 16, 2013 and recorded October 17, 2013 in Book 13771 Page 227 in the Office of the Register of Deeds for York County, South Carolina. Thereafter, Wanda Catoe died on March 28, 2013 and her interest in the subject property passed to Terry Catoe by operation of law; further shown in Deed dated February 2, 2022 and recorded February 7, 2022 in Book 19963 at Page 77 of said Records. Thereafter, Terry Catoe died on May 19, 2024, leaving the subject property to his heir/devisee Catherine Newton. CURRENT ADDRESS OF PROPERTY: 4024 Redwood Dr, Rock Hill, SC 29732 TMS: 586-01-10-020, 586-01-10-019, 586-01-10-021 TERMS OF SALE: The successful bidder, other than the Plaintiff, will deposit with the Master In Equity, at conclusion of the bidding, five percent (5%) of his bid, in cash or equivalent, as evidence of good faith, balance to be paid within 20 days of the sale. The deposit will be applied to the purchase price in case of compliance, but in the case of non-compliance to be forfeited and first applied to the costs incurred by the Plaintiff related to the sale and the balance then applied to the Plaintiff's debt in a manner suitable to the Plaintiff. Should the last and highest bidder fail to comply with the terms of the bid, the Master In Equity may re-sell the property on the same terms and conditions on the same or some subsequent Sales Day. No personal or deficiency judgment being demanded, the bidding shall not remain open after the date of sale and shall be final on that date, and compliance with the bid may be made immediately. Purchaser to pay for documentary stamps on the Deed. The sale shall be subject to taxes and assessments, existing easements and restrictions, easements and restrictions of record and any other senior encumbrances.
