Substituted Trustee's Notice of Sale
WHEREAS, on March 16, 2020, Jay Knowles executed a certain Deed of Trust to Kenneth R. Hall, as Trustee for the benefit of State Bank & Trust Company, which was recorded on March 17, 2020 in the Real Property Records in the Office of the Chancery Clerk for the First Judicial District of Harrison County, State of Mississippi as Instrument # 2020-2420T-J1 (the "Deed of Trust"); WHEREAS, on April 1, 2020, BankPlus's corporate parent, BancPlus Corporation acquired State Bank & Trust Company's corporate parent, State Capital Corporation, and caused State Bank & Trust Company to be merged with and into BankPlus; WHEREAS, BankPlus, as successor-by-merger to State Bank and Trust Company, has heretofore substituted Christopher H. Meredith as Trustee in and for the Deed of Trust and the indebtedness secured thereby in lieu and in place of Kenneth R. Hall and any other or subsequent trustees thereunder, by instrument recorded in the Records on October 18, 2023, as Instrument # 2023-21466T-J1; and WHEREAS, default having been made under the terms and conditions of the Deed of Trust and all of the indebtedness secured thereby having been declared to be due and payable in accordance with the terms of the Deed of Trust, BankPlus, the legal holder of the Deed of Trust and the indebtedness secured thereby, has requested the undersigned Substituted Trustee, Christopher H. Meredith, to execute the trust and sell the land, property, and all fixtures subject thereto in accordance with the terms of the Deed of Trust for the purpose of raising the sums due, together with attorney's fees, Substituted Trustee's fees, and expenses of sale, NOW, THEREFORE, I, Christopher H. Meredith, Substituted Trustee in the Deed of Trust, will on Tuesday, September 16, 2025 offer for sale at public outcry and sell within legal hours (being between the hours of 11:00 a.m. and 4:00 p.m.) at the East main door of the Harrison County Courthouse located at 1801 23rd Avenue, City of Gulfport, County of Harrison, State of Mississippi, to the highest and best bidder for cash, the following described property situated in the First Judicial District of Harrison County, Mississippi (the "Property"), to-wit: A parcel of land situated in the Southeast 1/4 of the Northeast 1/4, lying North of Kiln-Delisle Road and the Northeast 1/4 of the Southeast 1/4, lying North of Kiln-Delisle Road, all in Section 30, Township 7 South, Range 13 West, Harrison County, Mississippi and being more particularly described as follows: Beginning at a 1/2" iron rod set at the intersection of the North margin of Kiln-Delisle Road and the West margin of Cleo Smith Road; thence along the said North margin of Kiln-Delisle Road, N 54° 18' 15" W 1635.28 feet to a 1/2" iron rod found, said iron rod lying on the West line of said Southeast 1/4 of the Northeast 1/4 of Section 30; thence along said West line, N 00° 25' 22" E 436.68 feet to an axle found at the Northwest corner of said Southeast1/4 of the Northeast 1/4; thence N 89° 45' 35" E 96.54 feet to a 1/2" iron rod found; thence N 89° 57' 37" E 208.81 feet to a 1/2" iron rod found; thence N 89° 55' 06" E 376.37 feet to a 1/2" iron rod found; thence N 89° 54' 28" E 631.61 feet to a 1/2" iron rod found, lying on the said West margin of Cleo Smith Road; thence along said West margin, S 00° 28' 23" E 1392.98 feet to the Point of Beginning, containing 27.69 acres, reference meridian for bearings based on grid North by GPS observation.
