AERC Acquisition Corporation, dba DART, A Clean Earth Company AERC Acquisition Corporation, dba DART, A Clean Earth Company NCD 121 700 777 located at 4132 Pompano Road, Charlotte, North Carolina 28216 owns and operates a permitted commercial hazardous waste facility that has been in operation at this location since 1984. The facility is located off Hoskins Road, north of Interstate 85, east of Brookshire Parkway and west of Beatties Ford Road. Clean Earth is hereby providing this annual notice in accordance with the requirements of North Carolina General Statute 130A-295.01 (e)(2). The Clean Earth facility is permitted to manage solid and hazardous waste both in containers and tanks in accordance with its hazardous waste management permit issued by the North Carolina Department of Environmental Quality ("NCDEQ"). The permit allows the facility to store 107,773 gallons of hazardous waste in containers and store up to 105,600 gallons of hazardous waste in tanks. A security and fire protection system consisting of perimeter fencing, fire sprinklers, and electronic monitoring is present. Engineered spill control and secondary containment structures are present at the facility for tanks, containers and shipment receiving areas. Clean Earth receives and processes solid and hazardous wastes produced by industrial, governmental, and commercial entities, as well as solid and hazardous wastes generated by local residents. These wastes include but are not limited to inks, paints, solvents, outdated chemicals, off-specification products, laboratory packs, contaminated environmental media such as soil and water, pollution control residues, corrosives, contaminated debris, and hydrocarbons. Wastes received are stored, treated, consolidated or transshipped to other facilities as designated in its operating permit. The facility is regularly inspected by NCDEQ six times during each month. The facility operates under a written contingency plan reviewed and approved by NCDEQ which is maintained at the facility. The contingency plan describes actions to be taken by designated Clean Earth personnel in the unlikely event of an unplanned fire, explosion, or a release at the facility. Designated governmental and private emergency response authorities maintain copies of the contingency plan. Should an event take place, a Clean Earth Company representative will notify the NCDEQ and, if necessary, seek the expertise and assistance of civil authorities such as the police, fire, local emergency planning commission, hospitals, or state emergency response authorities. The plan also describes the emergency equipment that is present at the facility, describes facility evacuation procedures, and provides information pertinent to facility representatives or emergency response authorities.
