WARRANT REGARDING NUISANCE ABATEMENT
THE PEOPLE OF THE STATE OF CALIFORNIA, TO THE FIRE MARSHAL OF THE COALINGA FIRE DEPARTMENT:
UPON DECLARATION AND GOOD CAUSE TO THE COURT, YOU ARE HEREBY COMMANDED TO:
1. Abate any and all public nuisances located at 154 Buchanan Street, City of Coalinga, County of Fresno, State of California, 93210, Assessor's Parcel Number 071-131-14. This Abatement Warrant is issued for the purpose of abating public nuisances that pose an imminent threat of harm and is limited to the terms and conditions stated herein.
2. The abatement shall encompass the recovery or demolition of the partially burned and structurally deficient dwelling located at 154 Buchanan Street, City of Coalinga, County of Fresno, State of California, 93210.
3. If necessary, such abatement shall include seizure and destruction of all personal property, including but not limited to trash, junk, and debris in the front yard, rear yard, and inside the structurally deficient dwelling located at 154 Buchanan Street, City of Coalinga, County of Fresno, State of California, 93210.
4. No personal property shall be destroyed if, prior to or during the abatement commanded by this abatement warrant, any person asserts to the Fire Marshal of the Coalinga Fire Department, orally or in writing, an ownership interest in that personal property and requests that the personal property not be destroyed.
5. The Fire Marshal of the Coalinga Fire Department shall, at least thirty (30) days prior to the commencement of abating the public nuisance described herein, cause this Warrant to be served on the owner(s) of 154 Buchanan Street, City of Coalinga, County of Fresno, State of California, 93210 to allow the owner(s) such time to gather any belongings they may have at the property.
6. The inspection and abatement commanded by this Warrant shall be completed within ten (10) days, beginning from the time of the first entry to abate and ending at the last exit from abating. The abatement commanded by this warrant shall occur only between the hours of 8:00 a.m. and 6:00 p.m.
7. The Fire Marshal of the Coalinga Fire Department shall, at least twenty-four (24) hours prior to commencement of abating the public nuisance described herein, cause to be posted a notice that states:
ALL PERSONAL PROPERTY ON THIS LOT, WHETHER DISCARDED TRASH OR NOT, WILL BE SEIZED AND PERMANENTLY DESTROYED WITHIN 24 HOURS. IF YOU OWN ANY PERSONAL PROPERTY THAT IS ON THIS LOT AND YOU DO NOT WANT IT TO BE SEIZED AND DESTROYED, YOU MUST INFORM THE FIRE MARSHAL OF THE COALINGA FIRE DEPARTMENT AT (559) 935-1652 OR 300 W. ELM AVENUE, COALINGA, CALIFORNIA, BEFORE THE SEIZURE AND DESTRUCTION.
8. The above-described notice shall be written in both English and Spanish, and it shall be posted on the front door of the residential unit at 154 Buchanan Street, City of Coalinga, County of Fresno, State of California, 93210.
9. Only reasonable force shall be used in the performance of the abatement commanded by this Warrant.
10. Within fourteen (14) days after the performance of the abatement commanded by this Warrant, the Fire Marshal of the Coalinga Fire Department shall cause to be filed with this Court a sworn return stating with reasonable particularity what actions were taken to abate the nuisances described in this Abatement Warrant and the results of those actions.
Wherefore, the Court finds probable cause for the issuance of this Warrant and does issue it.
