The following notice satisfies three separate but related procedural requirements of the U.S. Department of Housing and Urban Development ("HUD") for activities to be undertaken by the City of Miami, Florida.
Request for Release of Funds
On or about September 3, 2025, the City of Miami ("City") will submit a request to HUD for the release of HOME Investment Partnerships ("HOME") funds under Title II of the Cranston-Gonzalez national Affordable Housing Act of 1990 as amended, for the River Place project located at 1890 NW 19 Street, Miami, FL 33125. The project will be new construction of a 2-story multifamily building with a total of 9 units consisting of 1 studio/one-bathroom unit; 7 one-bedroom/one-bathroom units; and 1 two-bedroom/one-bathroom unit in the Allapattah neighborhood in the City of Miami. Estimated funding in the amount of up to $1,137,418 in HOME funds will be allocated to this project.
Finding of No Significant Impact
The City has determined that this project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 ("NEPA") is not required. Additional information for this project is contained in the Environmental Review Record ("ERR"), which is on file at the City of Miami Department of Housing & Community Development, 444 SW 2 Avenue, 9th. Floor, Miami, Florida, and may be examined or copied on weekdays from 8:00 A.M to 5:00 P.M.
Notice and Public Explanation of a Proposed Activity in the 100-Year Floodplain
The City has conducted an evaluation of the property located at 1890 NW 19 St, Miami, FL that is located in the AE Zone (FIRMette Map 1208C0311L EL 9) as required by Executive Order 11988 and 11990 in accordance with HUD regulations at 24 CFR 55.20 to determine the potential effect that is activity in the floodplain will have on the environment.
The city has determined that it has no practicable alternative other than to approve the proposed project described above. This activity will have no significant impact on for the following reasons:
1. The new construction activity of the property will be in compliance with all floodplain protection measures as stipulated by the City and County as a part of their participation in the National Flood Insurance Program.
2. The proposed activity will not displace or redirect flood waters in such a way that would seriously impact other areas.
3. The new multifamily property will be assisted with federal funds and will be required flood insurance.
4. This project will help increase the amount of affordable housing in the area.
Public Comments
Any individual, group, or agency disagreeing with this determination or wishing to comment on this project may submit written comments to the City of Miami Department of Housing & Community Development, 444 SW 2 Avenue, 9th Floor, Miami, Florida, 33130. All comments received by September 2, 2025, will be considered by the City prior to authorizing submission of a request for release of funds. Comments should specify which notice they are addressing.
Release of Funds
The City of Miami certifies to HUD that Mr. Arthur Noriega V, in his capacity as City Manager, consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD's approval of the certification satisfies its responsibilities under NEPA and related laws and authorities, and allows JMR 1890, LLC on behalf of River Place project to use Program funds.
Objections to Release of Funds
HUD will accept objections to its release of funds and the City of Miami's certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the City of Miami; (b) the City of Miami has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) the grant recipient has committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality.
Objections must be prepared and submitted via email in accordance with the required procedures (24 CFR Part 58) and shall be addressed to the HUD grant administration office at CPD_COVID-19OEE-MIAhud.gov. Potential objectors should contact HUD Miami Office via email to verify the actual last day of the objection period.
