SUBSTITUTED TRUSTEE'S NOTICE OF SALE
STATE OF MISSISSIPPI
COUNTY OF JACKSON
WHEREAS, on June 6, 2019, Tina Thames and Leslie C. Hull executed a Deed of Trust to John Kinard, as Trustee, for the benefit of Charter Bank, Beneficiary, which Deed of Trust is recorded in Deed of Trust Book 3589, at Page 360, in the office of the Chancery Clerk of the County of Jackson, State of Mississippi, encumbering certain property described in said Instrument; and
WHEREAS, Charter Bank merged into and is now The Citizens Bank of Philadelphia.
WHEREAS, under the terms of said Deed of Trust, the beneficiary or any subsequent holder of the note secured by said Deed of Trust is authorized and empowered to appoint and substitute another Trustee in the place of the Trustee named therein, at any time by writing, duly signed and acknowledged and recorded in the County where the premises are located; and
WHEREAS, on July 10, 2025, The Citizens Bank of Philadelphia substituted Robert T. Schwartz, of Gulfport, Mississippi, in the place and stead of the said John Kinard, named as Trustee in the above described Deed of Trust, which substitution of trustee is recorded in the office of the aforesaid Chancery Clerk in Book 4166 at Pages 659-661; and
WHEREAS, default having been made in the terms and conditions of said Deed of Trust and the entire debt secured thereby, having been declared to be due and payable in accordance with the terms of said Deed of Trust, and the legal holder of said indebtedness, The Citizens Bank of Philadelphia, having requested the undersigned Substituted Trustee to execute the trust and sell said land and property in accordance with the terms of said Deed of Trust for the purpose of raising the sums due thereunder, together with attorney's fees, trustee's fees and expenses of sale;
NOW, THEREFORE, I, Robert T. Schwartz, Substituted Trustee in said Deed of Trust, will on the 4th day of September, 2025, offer for sale and will sell at public outcry, to the highest bidder for cash, within the legal hours (being between the hours of 11:00 a.m. and 4:00 p.m.) at the main front door of the Circuit Court Building at 3104 Magnolia Street, Pascagoula, County of Jackson, State of Mississippi, the following described property situated and lying in the County of Jackson, State of Mississippi, to-wit:
The South 100 feet of Block A, of the Communy Tract as per plat thereof recorded in Plat Book 1, Page 23, of the Official Plats in the office of the Chancery Clerk of Jackson County, Mississippi. Less easement conveyed for right-of-way.
Being the same property as conveyed in Deed Book 1857, Page 416, Land Deed Records of Jackson County, Mississippi
I WILL CONVEY only such title as is vested in me as Substituted Trustee.
