SUBSTITUTE TRUSTEE'S NOTICE OF SALE WHEREAS, on February 28, 2023, Justin Kyle Merrill and Brittany Latasha Merrill, husband and wife executed a deed of trust for the benefit of Mortgage Electronic Registration Systems, Inc., as beneficiary, as nominee for CrossCountry Mortgage, LLC, its successors and assigns, which deed of trust was recorded on March 2, 2023, as Instrument No. 202303985, in Book 3974, Page 426, in the office of the Chancery Clerk of Jackson County, Mississippi, as having been modified by an agreement recorded on and recorded in Book4096, Page 859, in the office of the Chancery Clerk of Jackson County, Mississippi; Said Deed of Trust was last sold, assigned and transferred to CrossCountry Mortgage, LLC by assignment recorded in Book 4163, Page 804 in the office of the Chancery Clerk of Jackson County, Mississippi. WHEREAS, the holder of the deed of trust at the time of the substitution substituted McCalla Raymer Leibert Pierce, LLP as Trustee, as authorized by the terms thereof, by instrument recorded July 23, 2025 and spread at large upon the records in the office of the aforesaid Chancery Clerk as Instrument No. 202513639 in Book 4169, Page 106 prior to the posting and publication of this notice; and WHEREAS, default having been made in the terms and conditions of the deed of trust, and the entire debt secured thereby having been declared to be due and payable in accordance with the terms of the deed of trust, and the legal holder of said indebtedness, CrossCountry Mortgage, LLC, has requested the undersigned Substitute Trustee to execute the trust and sell said land, property and improvements in accordance with the terms of the deed of trust for the purpose of raising the sums due thereunder, together with attorney's fees, Substitute Trustee's fees and expenses of sale; THEREFORE, on September 3, 2025, the undersigned Substitute Trustee in the deed of trust, will offer for sale at public outcry and sell to the highest bidder for cash, within legal hours (being between the hours of 11:00 a.m. and 4:00 p.m.) at the front door of the Jackson County Courthouse at 3104 Magnolia Street, Pascagoula, Mississippi, the following described land, property and improvements lying and being situate in Jackson County, Mississippi, to-wit: That certain tract, piece or parcel of land situated in the Northeast 1/4 of the Northwest 1/4 of Section 32, Township 6 South, Range 5 West, Jackson County, Mississippi and more particularly described as follows, to-wit: Beginning at the Southeast corner of the Northeast 1/4 of the Northwest 1/4 of said Section 32 and run thence South 89 degrees 49 minutes 27 seconds West along the Southern Boundary of said Northeast 1/4 of the Northwest 1/4 a distance of 641.15 feet to the Point of Beginning of the property herein conveyed. And from said Point of Beginning continue thence South 89 degrees 49 minutes 27 seconds West along the South line of said Northeast 1/4 of the Northwest 1/4 a distance of 200 feet; thence run North 0 degrees 03 minutes 15 seconds West a distance of 290 feet; thence run North 89 degrees 49 minutes 27 seconds East a distance of 200 feet to old fence line; thence run South 0 degrees 03 minutes 15 seconds East a distance of 106.87 feet to the Southwest corner of a tract of land owned by E & M Enterprises; thence run South 89 degrees 49 minutes 27 seconds East along the South line of said E & M Enterprises property a distance of 174.17 feet; thence run South 00 degrees 03 minutes 15 seconds East a distance of 182.07 feet; thence run South 89 degrees 49 minutes 27 seconds West a distance of 174.17 feet to the Point of Beginning. I WILL CONVEY only such title as is vested in the Substitute Trustee.
