ORDINANCE NO. 05-2025 CITY OF PASCAGOULA, MISSISSIPPI AN ORDINANCE OF THE CITY OF PASCAGOULA, MISSISSIPPI AMENDING APPENDIX C, ARTICLE 5 OF THE CODE OF ORDINANCES REGARDING FLOODPLAIN MANAGEMENT AND FOR RELATED PURPOSES WHEREAS, Mississippi Code Section 17-1-3 authorizes the governing authorities of municipalities to enact ordinances promoting the health, safety, morals, or the general welfare of the community; and WHEREAS, Mississippi Code Section 21-19-25 authorizes the governing authorities of municipalities to enact by ordinance technical codes promoting the health, safety, or welfare of the community; and WHEREAS, Appendix C, Article 5, of the City of Pascagoula's Code of Ordinances establishes standards for flood hazard reduction; and WHEREAS, amending Appendix C, Article 5 of the City of Pascagoula's Code of Ordinances as set forth herein is in the City's best interests, insofar it will implement standards necessary to participate in the National Flood Insurance Program; and WHEREAS, the City Council for the City of Pascagoula hereby amends Appendix C, Article 5 of the City of Pascagoula's Code of Ordinances. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PASCAGOULA AS FOLLOWS:[1] SECTION 1. Appendix C, Article 5, Section A, Subsections 5 and 11 are hereby amended as follows: (5) Electrical, heating, ventilation, plumbing, air conditioning equipment and other service facilities shall be designed and/or located to a minimum of 1 foot above BFE (freeboard) so as to prevent water from entering or accumulating within the components during conditions of flooding. (11) New construction and substantial improvements shall have the lowest floor elevated to no less than 1 foot above BFE (freeboard) or one foot above the highest crown of an adjacent street or roadway for zone x, unless the topography of the property does not allow for strict adherence as determined by the building official, or one foot above the elevation stipulated for that parcel by the Pascagoula Floodplain Management Map, whichever is greater. SECTION 2. Appendix C, Article 5, Section B, Subsections 1 and 4.a. are hereby amended as follows: (1) Residential construction. New construction or substantial improvement of any residential building (or manufactured home) shall have the lowest floor, including the basement, elevated to no lower than one foot above the elevation a minimum of 1 foot above BFE (freeboard) stipulated for that parcel by the Pascagoula Floodplain Management Map. Should solid foundation perimeter walls be used to elevate a structure, openings sufficient to facilitate the unimpeded movement of floodwaters shall be provided in accordance with the standards of Article 5, section B(3). (4) Standards for manufactured homes and recreational vehicles. a. All manufactured homes placed, or substantially improved, on individual lots or parcels, in expansions to existing manufactured home parks or subdivisions, in a new manufactured home park or subdivision or in substantially improved manufactured home parks or subdivisions, must meet all the requirements for new construction, including elevation and anchoring and the flood openings requirements of Article 5, Section B (3). (i) Elevated on a permanent foundation to have its lowest floor elevated to no lower than 1 foot above the base flood elevation a minimum of 1 foot above BFE (freeboard). (ii) Securely anchored to an adequately anchored foundation system to resist flotation, collapse, and lateral movement. SECTION 3. This ordinance shall become effective as provided by law.
