POTTER TOWNSHIP Centre County, Pennsylvania NOTICE OF ENACTMENT OF ORDINANCE AUTHORIZING THE INCURRENCE OF NONELECTORAL DEBT NOTICE IS HEREBY GIVEN that at a public meeting held on July 21, 2025, the Board of Supervisors of Potter Township (the "Township") enacted an ordinance (the "Ordinance") authorizing the incurrence of nonelectoral debt by the Township evidenced by a $330,000 General Obligation Note, Series of 2025 (Tax-Exempt) (the "Note") to finance bridge repair construction work in the Township. The Ordinance approves the sale of the Note at a private sale by negotiation and accepts a proposal (the "Proposal") for purchase of the Note to the Commonwealth of Pennsylvania, Department of Transportation (via the Pennsylvania Infrastructure Bank) ("PennDOT"), which was presented at the meeting. PennDOT has agreed to purchase the Note at a purchase price of $330,000. Pursuant to the terms of the Ordinance and the Proposal, the Note shall carry a fixed annual interest rate of 4.25% per annum. The Note is set to mature ten years from execution. The Ordinance provides that the Township will covenant that it shall include the amount of debt service on the Note for each fiscal year in which sums are payable in its budget for that year; shall appropriate such amounts to the payment of such debt service; and shall duly and punctually pay or cause to be paid the principal of the Note and the interest thereon at the dates and places and in the manner stated in the Note according to the true intent and meaning thereof, and for such proper budgeting, appropriation, and payment, the full faith, credit and taxing power of the Township will be irrevocably pledged. A summary of the Ordinance was advertised on July 15, 2025 and the proposed text of the Ordinance was available for inspection at the Township Office both in accordance with the requirements of the Local Government Unit Debt Act, 53. C.S. § 8001 et seq., as amended.
