NOTICE OF SALE UNDER POWER STATE OF GEORGIA COUNTY OF BIBB Under and by virtue of the power of sale contained in that certain deed to secure debt from Bobby Junior Chapman and Juliet Clark (the "Grantor") to Next Generation Lending, LLC (the "Lender"), dated December 22, 2023, and recorded in Deed Book 11760, Pages 114-117, Clerk's Office, Bibb County Superior Court, (said deed to secure debt is hereinafter referred to as the "Security Deed), said Security Deed having been given to secure that certain promissory note dated December 22, 2023, executed by Grantor in favor of Next Generation Lending, LLC, in the original principal amount of Thirty-Five Thousand and 00/100 Dollars ($35,000.00), together with interest thereon as set forth therein and together with all extensions or renewals thereof and all other indebtedness or obligations of Grantor to Lender (the "Note"), there will be a sale at public outcry to the highest bidder for cash before the Courthouse door of Bibb County, Georgia, within the legal hours of sale on the first Tuesday of September 2025, to-wit: (September 2, 2025), the following described real property (the "Property"), together with all fixtures and improvements located thereon and all rights, members and appurtenances thereunto belonging or in anywise appertaining: All that tract or parcel of land situate, lying and being in Bibb County, Georgia, in the City of Macon, being known and distinguished as Lot No. 5 and Lot No. 6, Block A of Lynmore Place, being more particularly described according to plat of record in Plat Book 4, Pages 46 and 47, re-traced in Plat Book 8, Page 79, Clerk's Office, Bibb Superior Court, which said plat is by this reference thereto incorporated herein for the purposes of a more particular and accurate description of said Lot No. 5 and Lot No. 6 hereby conveyed. Said Lot No. 5 and Lot No. 6, Block A of Lynmore Place are more particularly described according to said last mentioned plat, in the aggregate, as fronting a total distance of 100 feet on the northerly right-of-way of Lynmore Avenue and extending back therefrom in a northerly direction, with a width of 100 feet and being 140.7 feet along its westerly line, adjacent to Lot No. 7 and being 140.7 feet along its easterly line, adjacent to Lot No. 1 and Lot No. 2 and being, in the aggregate, a distance of 100 Feet wide across the rear thereof. There are improvements located thereon known under the present system of numbering as 631 Lynmore Avenue, Macon, Bibb County, Georgia. The debt secured by the Security Deed has been and is hereby declared due because of, among other possible events of default, the failure to pay the indebtedness as and when due and in the manner provided in the Note. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, including attorney's fees. The Property will be sold as the property of Bobby Junior Chapman and Juliet Clark, subject to all zoning ordinances; matters which would be disclosed by an accurate survey or by an inspection of the Property; any outstanding taxes, including but not limited to ad valorem taxes which constitute liens upon said Property; special assessments; all outstanding bills for public utilities which constitute liens upon said Property; and all matters of record superior to said Security Deed, including, but not limited to, any Federal tax liens. This sale will be conducted subject to (1) confirmation that the sale is not prohibited under the U.S. Bankruptcy Code, (2) the provisions of O.C.G.A. Section 9-13-172.1 which permits the rescission of judicial and nonjudicial sales in the State of Georgia in limited circumstances, and (3) final confirmation and audit of the status of the loans with the holder of the Security Deed. Notice has been given of intention to collect attorney's fees in accordance with the terms of the Note secured by said Security Deed. Notice has also been given, in writing and by certified mail, return receipt requested, to Grantor, of the name, address, and telephone number of the individual or entity who shall have full authority to negotiate, amend, and modify all terms of the Security Deed and the Note thereby secured in accordance with O.C.G.A. Section 44-14-162.2(a). To the best knowledge and belief of the undersigned, the parties in possession of the Property are Bobby Junior Chapman and Juliet Clark, or tenant or tenants, and the proceeds of said sale will be applied to the payment of said indebtedness and the expenses of said sale.
