NOTICE OF POWER OF SALE CONTAINED IN SECURITY DEED STATE OF GEORGIA COUNTY OF MUSCOGEE Under and by virtue of the power of sale contained in that certain Deed to Secure Debt from RESHAYNIA COLEMAN (hereinafter referred to as "Grantor") to COLUMBUS HOUSING INITIATIVE, INC. dba NEIGHBORWORKS COLUMBUS, dated August 14, 2020, and recorded in Deed Book 13055, Page 296, Muscogee County, Georgia records, (hereinafter referred to as the "Security Deed"), Columbus Housing Initiative, Inc., the present holder of the Promissory Note and Security Deed defined herein, (hereinafter referred to as the "Secured Creditor") as attorney in fact for Grantor, will sell at public outcry to the highest and best bidder for cash between the legal hours of sale before the courthouse door of Muscogee County, Georgia on the first Tuesday in September, 2025, (September 2, 2025), the following described property (the "Property"), to-wit: All that lot, tract or parcel of land situate, lying and being in the State of Georgia, County of Muscogee and City of Columbus and being part of Lots 19 and 18 in Block 21 of the NORTH HIGHLAND LAND IMPROVEMENT AND MANUFACTURING COMPANY PROPERTY, and being particularly described as follows: BEGINNING at an iron stake placed on the south side of 35th Street, eighty-nine and five-tenths (89.5) feet North 88 degrees 25 minutes East from the southeast corner of the intersection of 35th Street with 3rd Avenue and from said beginning point running Thence North 88 degrees 25 minutes East, along the south side of 35th Street 42.5 feet to an iron stake placed on the south side of 35th Street 167.74 feet South 88 degrees 25 minutes West from the southwest corner of the intersection of 35th Street with 4th Avenue; thence running South 88 degrees 25 minutes West 42.5 feet to an iron stake; thence running North 01 degree 30 minutes East 100.0 feet to an iron stake; thence running South 88 degrees 25 minutes West 42.5 feet to an iron stake; thence running North 01 degree 30 minutes West 100.0 feet to the iron stake which marks the point of beginning- upon which is situate house numbered 304-35th Street, according to the present system of numbering houses in said City of Columbus. The above described property is shown on a map or plat entitled "Property of Swift Spinning Mills, Inc., Lots 17, 18, 19, A, B and C, Block 21, North Highland Land Improvement Manufacturing Co. Survey, Columbus, Muscogee County, Georgia", made by Aldridge, Moon, Russell & King, Civil Engineers, March 8, 1956, and revised April 9, 1956, a copy of which said map or plat is recorded in Plat Book 16, Folio 39, in the office of the Clerk of Superior Court, Muscogee County, Georgia. The above-described property is hereby conveyed subject to all applicable easements and rights of way of record. Said property has a current street address on 304 35th Street, Columbus, Georgia. Said Security Deed secures that certain promissory note dated August 14, 2020, made by Reshaynia Coleman in favor of Columbus Housing Initiative, Inc., dba NeighborWorks Columbus, in the original principal amount of Sixty Five Thousand Nine Hundred Fifty and 00/100 ($65,950.00) (hereinafter referred to as the "Promissory Note"), together with any and all other indebtedness owed by Grantor to Secured Creditor. The indebtedness arising from the Promissory Note has been and is hereby declared due because of default under the terms of the Promissory Note. The indebtedness remaining in default, the sale will be made for the purpose of applying the proceeds thereof to the payment of the indebtedness secured by the Security Deed, accrued interest and expenses of the sale, and all other payments provided for under the Promissory Note and Security Deed, including attorney fees as provided in the Promissory Note and Security Deed, notice of intention to collect attorney fees having been given as provided by law; and the remainder, if any, shall be applied as provided by law. The following information is being provided in accordance with OCGA § 44-14-162.2. Columbus Housing Initiative, Inc., dba NeighborWorks Columbus, is the Secured Creditor under the Security Deed and loan being foreclosed. The following entity shall have full authority to negotiate, amend, and modify all terms of the above-described Security Deed and associated note on behalf of the Secured Creditor: Columbus Housing Initiative, Inc., dba NeighborWorks, 345 6th Street, Columbus, Georgia; Telephone No.: (706) 221-8204, Attn: Foreclosures. OCGA § 44-14-162.2 states in pertinent part that, "nothing in this subsection shall be construed to require a secured creditor to negotiate, amend, or modify the terms of a mortgage instrument." The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code, and (2) to final confirmation and audit of the status of the loan with the holder of said Security Deed. Said property will be sold subject to all liens, encumbrances, unpaid real estate ad valorem taxes and governmental assessments and to all prior restrictions, rights-of-way, and easements of record, if any, appearing of record prior to the date of the Security Deed and those appearing after the date of the Security Deed and consented to by the Secured Creditor.
