NOTICE OF INTENTION TO SELL REAL PROPERTY AT PRIVATE SALE
Notice is hereby given that, subject to confirmation by this court, on August 6, 2025, at 10:00 a.m., or thereafter within the time allowed by law, the undersigned as Administrator of the Estate of the above-named Decedent, will sell at private sale to the highest and best net bidder on the terms and conditions hereinafter mentioned all right, title, and interest of the Decedent at the time of death and all right, title, and interest that the Estate has acquired in addition to that of the Decedent at the time of death, in the real property located in the City of Atwater, County of Merced, State of California, more particularly described as follows:
LOT 39, AS SHOWN ON THE MAP OF TRACT NO. 05-5, "ATWATER SOUTH", FILED FOR RECORD ON JANUARY 11, 2006, IN VOLUME 72 OF OFFICIAL PLATS AT PAGES 21-26, MERCED COUNTY RECORDS, AMENDED BY A CERTIFICATE OF CORRECTION RECORDED JUNE 1, 2006 AS INSTRUMENT NO. 2006-039168 OF OFFICIAL RECORDS.

This property is commonly referred to as 1939 Faxon Drive, Atwater, CA 95301.
The sale is subject to current taxes, covenants, conditions, restrictions, reservations, rights, rights of way, and easements of record, with any encumbrances of record to be satisfied from the purchase price.
The property is to be sold on an "as is" basis, except for title.
The personal representative has given an exclusive listing to London Properties, Ltd. DRE #00463722.
Bids or offers are invited for this property and must be in writing and will be received at the office of Berliner Cohen, LLP, attorneys for the Administrator, at 548 W. 21st Street, Merced, CA 95340 or delivered to Berliner Cohen, LLP personally, at any time after first publication of this notice and before any sale is made.
The property will be sold on the following terms: cash, or part cash and part credit, the terms of such credit to be acceptable to the undersigned and to the court, no less than 2% of the amount of the bid to accompany the offer by certified check, and the balance to be paid on confirmation of sale by the court. Taxes, rents, operating and maintenance expenses, and premiums on insurance acceptable to the purchaser shall be prorated as of the date of confirmation of sale. Examination of title, recording of conveyance, transfer taxes, and any title insurance policy shall be at the expense of the purchaser or purchasers.
